Got pulled over

The point of this thread is to know if I'm in the wrong or I did waste an hour of my life.

So driving back home with some friends after eating out, SAPS pulls me over. I get out of the car, the officer calls me by surname not sure how he knows but he then asks for my license, I hand it over and the usual have you been drinking bla bla.

So he proceeds to ask my friends to get out and he searches and whatever. Then he says there's a problem and I ask what and he goes on about the number plate not matching the license disc.

I explain that I got the car registered but I didn't do the road worthiness test hence the disc has the old number plate but its still valid.

He goes about there is going to be a fine. Being SAPS he can't issue a fine so we follow him to where the Metro guys are, I don't know the CBD well.

The Metro guy says technically you can't issue a fine but it's falsifying plates so now we go on another trip to Durban station because I'm about to be arrested.

We get there, he decides to radio someone giving them my number plate and they give my info as the registered owner. Then they go on to give the previous number plates, VIN number etc.

At this point he asks for the previous number plate, and I explain when I did the new number plates they disposed of the old one. Which is illegal according to him.

After hearing the argument over and over again, eventually I was told I can go.

TLDR: New registration number plates not matching old valid license disc, is it illegal to be on the road.

IIRC the K53 pre-trip inspection includes checking that the licence disk is valid AND that it corresponds to the number plate so I think it would be illegal if they don't match.

5. Walk to the front of your car, say - Engine cap is closed. Say - lights and corner lamps are secure and working, numberplate is secure and corresponds to license disk.

I usually keep the old plates on the car with the old disk until it's all sorted

Registration plates that don't match your disc is definitely not legal.

I dont know how much it applies today still, but when i was studying in Potch i got nuked by a patrolling SAPS officer that noticed my rear number plate doesn't match the disc. (Was in an accident and the panel beaters replaced the plate at the back, one of the numerals was swapped with the other, but other than that still the same, i never even noticed myself). I got fined R300 and the plate was confiscated. Thats pretty much the extent of it. Mind you that was 2003, so like i said, things might be different now. Dunno how drastically vehicle rules have changed since then.

Under aarto, plate not matching disk is an offense, not an infringement. So it's a court hearing.

BS SAPS can issues speeding fines and parking tickets etc. There is no restriction on the laws they may enforce.

They just dont do it cos the paperwork is @#$@#$@#$

This sort of thing is almost always done for you when you buy a car.

Anyway, in front of a cop isn't a nice way to learn.

This here doesn't make sense to me. AFAIK you can't get a vehicle registered on your name without a roadworthy.
So you do the roadworthy, they issue you the certificate. You then take that with you for registration.
The official gives you your papers with the new disc and new plate number
So how the f*** did you get your reg papers?

You can register a car without roadworthy. You pay for both registration and licensing, get the reg papers and then get the licensing receipt without the license disk at the bottom of the paper

Really doesn't sound plausible hey.. Did this a while back and before you get the Reg you need to provide the road-worthy certificate.

its very much plausible and ahoudet is correct.

for example if the car is broken for whatever reason and may take time to fix it will be difficult for the buyer to get the roadworthy certificate, and thus the buyer may accumulate licensing penalties for no real justifiable reason.

so the authorities simply withhold the disc pending roadworthy and you can continue to pay the licensing

The SAPS will need to issue what is called a J534. Now a J534 is a direct court summon and with this, a docket is actually opened. Rather be glad the SAPS didnt issue the J534.

Even in future, dont moan the SAPS didnt issue the fine, you rather not have a J534.

Having mismatching disc/plates, it is illegal. You are lucky that you arent in the cells.

Be nice to the officers, its a hectic career

Yup. I remember taking your advice in one of my other threads. Insurance was pushing me for COR so I got everything done through a guy in Durban. Gave him the docs etc and he got registration sorted and fitted my new plates.

I am thankful I just didn't know and I went travelling around the CBD for an hour.
