Gym Contract

Hey guys,

Not sure if anyone can shed some light on this issue.

I signed up for a gym contract in November using the discovery benefit. I requested the discovery benefit to be activated which it never was. I checked my account this week and see I am been billed full price.

I contacted the gym to cancel my contract they now want to charge me 80% of the year subs to cancel the contract because I am on a discovery contract. My argument is I have never got the discovery activate hence it is a normal contract.

Anyway, they are not budging and I must either activate with discovery or cancel (pay R2000) to get out of the contract.

(I am asking as I really don't need the gym membership anymore)

Do you think I can get out of this or must I just cough up the money?
 
Might have a case via the CPA, but don't know.
 
When I signed up with Virgin Active I was told they deem "reasonable" to mean 30% of the remaining amount and the contract is only for 1 year. I actually wrote it into the contract and signed it, and they accepted it. I also used my Vitality benefit and I immediately only payed 20% of the full amount.

Which gym is this? Name and shame bud! The problem is everyone actually needs to exercise. So unless you training outdoors you should probable keep the contract and activate it with Vitality and start going. Try organise a deal with them,however the CPA knows these gyms are dodge so I am sure they will be able to help.

It will become a little more complex since their is a 3rd party involved(that being discovery). Good luck.

Well, I landed up paying the discovery fee and will have to travel a little further to the gym. I am just tired of south african companies taking us for a ride. Rather than look after their customers they try and screw you over, like forcing you to pay for a gym contract that you don't really need anymore.

It was Planet Fitness by the way. Once the 12 months is up I will move and never go back to them again. And when people ask for a reference, it won't be from planet fitness.
