Johannesburg - Two brothers accused of masterminding a multimillion dollar airport heist want their prosecution stayed.

Shaheed Rudolph and Rashdeen Rudolph claim they qualify on the same grounds advanced by African National Congress president Jacob Zuma for his stay of prosecution.

The brothers brought an application in the Kempton Park Magistrate's Court on Tuesday to halt their prosecutions.

The advocate prosecuting the case, Willemien Vos, said the State had decided to prosecute the brothers, but later withdrew the charges.

It had since reinstated the case.

The Rudolphs were contending that the State should have sought their representations before prosecuting them again, said Vos.

The case was postponed to July 6.

The brothers were arrested in October 2008, after being fingered by State witnesses as kingpins in the 2006 robbery.

On March 25, 2006 robbers, armed with AK-47 assault rifles, boarded an SA Airways plane and stole R72m in foreign currency.

Twelve people are standing trial in the high court in Johannesburg for the crime.

Three others, Magdeline Moonsammy, Sean Soobramoney and Ishmail Nazir, pleaded guilty in October 2008 under plea agreements with the State.

Two others - Themba Phuyitsi and Tebogo Nhlapo - died of natural causes while awaiting trial.

I doubt that kind of tactic can be used by "ordinary" citizens, aka Rednosed Rudolph and his criminal boetie.

Hmmm...sounds like they fell down a mine shaft onto some bullets or something. :D
 
our law system work of statues..... if something has been done before in a case.. its should be adhered to again..
