HELP REGARDING CREDIT BUREAU JUDGMENT!!!

Hi. I have never signed a consent for a judgment but on my credit report a judgment had been loaded also if the judgment had been loaded rightfully are they suppose to garnish my salary because they haven't and 4 years have gone by? It seems these are a shady bunch of attorneys that used to deal with std bank who loaded this judgment and when i phoned them to assist me when paying off the judgment and having it rescinded they are pushing me from pillar to post referring me to a ton of other attorneys and recovery companies who are unhelpful. What do i do as this is hindering my life in obtaining essential credit as i am in a good position to afford the installments for future credit.

After 3 years of the last payment the debt can be rescinded. If you signed something in the meantime or admitted to the debt then you cannot rescind it any more, only after 3 years of the date that you acknowledged the debt you can rescind it again if no payment was made for 3 years.

Get yourself a lawyer or get legalwise and let them deal with the credit company on your behalf. They will take chances and wont help you, you will have to help yourself. I had the same issue with a company and after I got my lawyer involved they didnt take any chances and it got scraped at the end of the day.

Without my lawyer they had random people phoning me constantly asking the same thing over and over and when I would ask for proof etc they would ignore me only to phone me the next day with the same questions.

BTW if they got a judgement on you after the rescinded period you can take them to court and make quite a bit of money as that is illegal and as a credit company they are well aware of this. They will also get a massive fine and lose their licence.

Thanks for you quick response Goofysmurf and Grubscrew. I have never paid the debt for roughly 3 and half years never paid an installment since judgment was loaded and never agreed to make a payment arrangement with them. What documents and proof do i need to approach legal help?

I suggest you sign up for legalise as this will be the cheapest its under R100 a month. Then speak to them give them all your documents and they will take it over from there. Tell them the debt must be rescinded as its over 3 years and then sit back and relax and wait for them to resolve it. The lawyers will tell you what documents they need etc and will communicate if they need anything else.

Or just get a lawyer anywhere they will be able to assist and make this go away.
