They do have to investigate. The gentlemen could have just been asking for directions to the bank or nearest police station to hand in their guns.Attempted hijacking will be the hijacker.
Murder will be the guy defending himself.
SA law makes it clear (wrongly) that life is worth more than ANY property no matter the value. They make it almost impossible to defend yourself, your family or your property.
No. Wrong. Both are dockets that are opened, as is procedural in South Africa.Attempted hijacking will be the hijacker.

Agree.No. Wrong. Both are dockets that are opened, as is procedural in South Africa.
Attempted hijacking - nothing will come of it, as there's nobody to charge. The only person in custody is kinda morgue-ish.
Murder - it's standard. You're not allowed to shoot anyone, but in certain circumstances (like private defence), you are pardoned. Often people don't even appear in court.
Remember just because a case and a docket is opened, doesn't mean anyone is being charged with a crime. Also, you are allowed to defend your property. A lawyer wrote a good bit on it years ago. Something along the lines of - you are watching a guy running toward your house with a petrol bomb. Your house contains your entire earthly possessions. You can then shoot that man. There's a lot on it, our law covers that. For example:

Shooting a person who threatens your life seems like a clear-cut case, but legally, it's not that simple.www.news24.com
Also, please stop spreading rumours such as "They make it almost impossible to defend yourself, your family or your property." It's not good for anyone.

He will not be charged with anything. And the guy defending himself will not be charged with Murder but with Culpable Homicide as i understand the procedure.
Yes, he was charged with "endangering" and "discharge of a firearm in public".He will not be charged with anything.
No murder is the docket. There's no charge until they find he's done something wrong.Murder is the preliminary charge until facts are ascertained, no?
Well a docket is opened and investigated at the very least.. I used the word charged a bit loosely, apologies. He will not be charged with anything.
Explained eloquently. No murder is the docket. There's no charge until they find he's done something wrong.
Remember you're not automatically charged. Cases are opened and investigated. If the investigation finds that the shooter acted unlawfully AND the state prosecutor thinks they stand a chance to get the shooter convicted, only THEN will he be charged.
If the shooting was in private defense, and it's found as such, he will never be charged.
