Hijacker dies after Porsche driver opens fire

Yes, fine but does not always work out well.

My neighbour is visiting his friend in Parow. As goes to leave, two guys jump out a car and get into his and want to drive off. But he has the keys in his pocket. The thief pulls out a knife and tells him to had over the keys. Instead he pulled out his gun and shoots him. The second guy runs off. Th avoid too much blood in the car, he pulls him out and he is now bleeding on the drive

SAPS arrive and arrest the neighbour and put him in the van. Ambulance arrives 25 mins later. Fellow has gunshot wound in his upper arm, nothing fatal

The friend in Parow calls his own neighbour who is an attorney. They go together to SAPS Parow and get him out of the cell, where spent 2 hours. SAPS said he must appear in court in 3 days. He gets to court to find nothing on the roll

They do have to investigate. The gentlemen could have just been asking for directions to the bank or nearest police station to hand in their guns.

No. Wrong. Both are dockets that are opened, as is procedural in South Africa.

Attempted hijacking - nothing will come of it, as there's nobody to charge. The only person in custody is kinda morgue-ish.
Murder - it's standard. You're not allowed to shoot anyone, but in certain circumstances (like private defence), you are pardoned. Often people don't even appear in court.

Remember just because a case and a docket is opened, doesn't mean anyone is being charged with a crime. Also, you are allowed to defend your property. A lawyer wrote a good bit on it years ago. Something along the lines of - you are watching a guy running toward your house with a petrol bomb. Your house contains your entire earthly possessions. You can then shoot that man. There's a lot on it, our law covers that. For example:

Load of tosh actually.

And the guy defending himself will not be charged with Murder but with Culpable Homicide as i understand the procedure.

It is very easy to defend yourself and your family in this country... your property is a little bit more of a grey area, but even that usually involves threats to you directly so it stops being a defense of property and becomes a defense of self which is easy.

No murder is the docket. There's no charge until they find he's done something wrong.

Remember you're not automatically charged. Cases are opened and investigated. If the investigation finds that the shooter acted unlawfully AND the state prosecutor thinks they stand a chance to get the shooter convicted, only THEN will he be charged.

If the shooting was in private defense, and it's found as such, he will never be charged.

But I don't have a Porsche for them to hijack...
