Encoding is mostly used for specialized products, when there is a small market.

So if you develop online time management software for honest politicians, there is not a big market for it. So you would want to encode that. You are obviously allowed to monetize your work as you please, while staying realistic.

If it’s part of an open source project then it’s a different story. But I have seen WordPress themes with base 64 encoded footers. And I’m not just talking “nulled” commercial themes from RapidShare I’m talking theme developer gives themes away for free with embedded sponsored links in the footer but sells a commercial link free version. Obviously blatantly against the spirit of GPL to encrypt the code like that.
