How binding is a cell contract with no device?

The way I understand it is after Cpa was introduced you can exit a cell contract(it's a data only contract with Telkom mobile) relatively easily and with minimal penalty if there is no device linked to the contract. I asked the clueless Telkom call center and they seem to think exiting the contract will cost me a once off R800, does that seem right?

Come on really?

They provide you with data at a reduced rate as you agreed to a certain time frame of which they are guaranteed a fixed income. If you want to cancel early they should be afforded the opportunity to make up their losses.

Does it matter what the laws says? Do you have the resources to fight them? You could probably argue that R800 is unreasonable, but only if you've got R5 000 000 available for a constitutional court challenge. Otherwise pay the R800 then throw a brick through their window like a normal person. (Edit: Anonymously, obviously.)

Steep but allowed from what I remember.. I once enquired about cancelling a contract two months before(was moving to Afrihost) and the fee on a R100 data/sim only contract was R500 on MTN.

So yah.. Not worth it, it's based on left over value and a standard fee

They quoted me R3k for 15 months with a router. Granted, it was the wrong contract they quoted me for but hey, a step in the right direction.

Now after another month of trying to contact the rep told me my cancellation form is with their cancellation department :/

Funny that you got the call center to get you a quote though. They always refer me to a person that tells me to fill out a form and wait for a call.

They grudgingly gave me a cancellation quote over the phone but ja, looks like I'm suckered, just as all the networks seem to be climbing on the discount data band wagon I resign a 24 month contract at 4yr old rates

No need to get all technical.

Works both ways, when their network starts working at snail pace for weeks on end they don't give a faq you paid for Lte speeds, no love lost. If there's a way out of the contract where I don't have to pay in a mint I'll take it.

I suppose then they shouldn't have a cancellation/retention department. And how about they deliver the speeds they said they could?

Surely that changes things then? I mean they cant base an exit fee on future income when they physically cannot provide you with the service you contracted them for?

I asked them and they said that's not a reason they will accept for not charging cancellation penalties. I seem to recall it was at some stage?
