You recon it is a good replacement for someone who is used to a s740 ? the only touch screen phone I have owned where the Jammin and the HTC Diamond .. both of which i didn't enjoy

and when would MTn have it avaliable

I had a P3400 and I really didn't like that it was just touch screen. Granted, it ran WM6.1 and WM6.5 is definitely more finger-friendly.
But I don't know if I could use a plain touch screen again. How often do you use your qwerty keyboard on your s740?
 
I stand under correction, but both phones you used previously were resistive, capacitive is much easier to type on. Maybe find someone who has a HTC Hero and play around with it for a couple of minutes, the Legend is basically an update to the Hero, faster hardware and newer software.

The availability date for the Legend is being toted as the first of May, but it remains to be seen when exactly they'll be available.

This is a very good suggestion. I don't particularly like typing on a touch screen, but all my touch screens have been resistive thus far.
It boils to a personal preference and tolerance level, so your best bet would be to have a test run on a capacitive screen and see if you think it would annoy you.
 
Touchscreens have really improved since the Jamin and Diamond. I personally also HAD to have a phone with a full QWERTY keyboard and in fact stopped using touchscreens at one stage. Since I got my Nokia 5800 I realised that I don't need a hardware keyboard anymore. Even resistive screens are quite responsive nowadays.

The Legend looks good and judging from the Hero I think it will be very responsive and a pleasure to use.

I'm also hoping to get a Legend on my upgrade.
