Thanks for all the extra info, I will definitely make use of that when I do get around to sending it in.Given all of the above, I would also lodge a complaint with the NCC stating that Huawei are "illegally" trying to deny your rights under the CPA.
I would mention this to the person at Huawei sending you the "T&A" form for the repairs and saying how it is illegal to require you to sign away your rights as protected by law.
Thanks, I must say I am really annoyed with the "no-can-do" attitude from both Huawei and CellC. I love the Huawei phones, but I must say...their after sales service is rubbish.Just remember that you cannot "sign away" your rights as protected by law. You cannot consent to have the law not apply to you.
The perfect rebuttal to those T&C's is to say that you cannot sign it in good conscience because it would be illegal.
Store policy cannot override the CPA. Store policy cannot force you to concede to unreasonable T&C's.

That's interesting, Huawei flat out told me they only do repairs and that's it - only the stores that sold the devices can do CPA claims (but as per CellC Huawei does these assessments).In terms of the CPA, all parties to the supply are liable, ie, both Huawei and CellC. I have started the process to submit a complaint to the relevant ombud...but, first step is official communication to them, with timeline and outcome requirements...I am now waiting to see whether they will resolve, if not I will submit the complaint. So let's see, hopefully they do the right thing. I just want the advertised service that made me choose this premium device in the first place.I can also confirm the VIP service from Huawei is just a gimmick. Been to the Melrose centre and they told me straight up that it doesn't exist and they don't provide loan phones, they don't fix the phones in the booked time slots that you book on the HiCare app and they don't repair it while you wait. They also do not do the laser engraving as stated they do in the VIP service, and they do not provide you with new screen protectors when your current one is a scratched, all of which are in the VIP service detail...
