However it's in the kids best interest. Let me see, B pays lets say R 5 000 maintenance and the kids get sick. Mother has no money to pay for the doctor not even to mention the Hospital. Now guess who will have to foot the bill

It's best to rathe pay R 2500 on medical aid and give the mother R 2500. If the mother is complaining she can go and try her luck at the courts and see what they say. That money is ment for the kids no matter how it's spent.

I fk'ng hate people like this who think of no one else but themself. This goes for the mother and the father.

That is what I thought would be fair too.

At the outset 5 years ago, the maintenance was meant to take care of 3 kids. 2 of those kids left the house and now have jobs of their own, so the maintenance should have been reduced pro rata, but the father never requested the court to do so, which is also a token of his generosity.

then it's settled then. A must take responsibility. maybe she can ask B to put the client on the medical aid, then reduce the maintenance amount since there's 1 child left. A is also unfair... A is not responsible... is A the reason why they got divorced? seems to me like A is not responsible(maybe i might be wrong by making such statements about A without knowing the whole story. But A is not fair at all)

maybe B thought that A would be responsible enough to do what's right for the children since he was giving her more than the amount of maintenance...

Medical aid should have been specified in the original contract but both parents had an obligation to make sure the child was safegaurded. A sounds like she is pushing her luck by asking B to pay more over and above the extra she now benefits from now that the other 2 kids are gone.

A should pay for the medical aid herself. Just because she was not smart enough to have that dealt with from the word go does not mean that B should now have to cough up more or that the child should pay for the irresponsibilities of the parents.
