My dad signed a trade in car contract that he does not understand .

My dad does not understand English very well nor can he write in English . This car dealership had been calling my dad non stop to come to the dealership and sign off his motorcycle as a trade in . They phoned a lot of times ,more than 30+ times using different phone numbers .

As seen on that my dad wasn’t budging to come to their dealership they made efforts to come to us .

I thought the salesmen were just here to show the car . Next thing I know they made my dad sign off his motorcycle. I neglected to say that my dad is old and he has poor eyesight plus not being able to read in English was a recipe for disaster.

This morning (monday)I asked the salesman to send me the picture of the documents so we I can evaluate them . And oh my goodness this man has been robbed in B-road daylight .

The motorcycle cost 405k and the bakkie that had been ‘sold’ to him had a mileage of 306k ,the price that is to be paid after 72 months for the bakkie is 498K. Also this is a 2017 TOYOTA hilux SINGLE CAB GD6

Long story short , We went to cancel the contract (today,Monday) and they said we can’t . It was a back and forth.


Any advice ?
 
Salesman sounds like a real piece of work.

CPA should protect him.

You may also need to get a doctor's note to certify that your father was not in a position to see/comprehend the document he signed.

I would sue them for all of that plus damages.

It looks there was every intention to defraud your dad according to this, so they had intent knowing it overides understanding of your dad's knowledge, in otherwords knowledged passed to your dad was not the same and understood as the intended motivation.
My question would be how did they came to know of your dad-?

We got a lawyer .. He looked at the contract thoroughly . He managed to pick up on things we couldn’t see.They faked my dad’s signature and one of the salesmen added themselves as the next of kin . They even added their own email on my dad’s info .

We’re just waiting to hear from our lawyer and MFC’s higher ups .

Holy ****. These bastards need to be nailed. Sorry this happened to your family and I hope it gets resolved.
