Here's my story as told to their debt collectors...

Hi ABC,



Let me start with a bit of history regarding iBurst. I initially signed a 2 year contract with iBurst in 2005 but canceled it withing the required 7 days. A reseller named A and B came to my house and offered me a 2 week free trial which I accepted. A created a new iBurst account for me and I paid the money for the modem (this was NOT a contract) into his account. Monthly subscriptions were also paid directly into his company’s account (Company X). From what I remember, I paid R469 from 2 May 2005 to 7 November 2006; A total of R8442.


Now from what I know, my initial account was never canceled even though I returned the modem and requested cancellation. The last time I spoke to one of their account managers, Shalini IIRC, she told me that the issue had been addressed but that they couldn’t get hold of A. In other words, they’re making their problem mine. I have bank statements to prove that I indeed paid A as mentioned above.

Please let them know that I’ll be posting this email on http://hellopeter.com and http://mybroadband.co.za to warn other potential customers that might end up in my situation due to incompetence. Also please let me know if you need bank statements and other information etc.

iBurst I don't owe you a cent! Find the reseller and get your money from him you morons! You want me to pay for a duplicate account that should've been removed when I canceled? I will not!

This will be posted on hellopeter as well.
 
If you are 100% sure about your case, do the following :

1. Go see a lawyer
2. Open a case of fraud at the police.
 
I'm going to mail them POP tomorrow morning. These morons can't manage their resellers and make it the customer's problem.
 
Surely your agreement was with the reseller not with iBurst. iBurst has no legal
standing in pursuing you. Read your agreement's TOS.

What iBurst is doing is pursuing you for that initial contract they think
you never cancelled. Surely you had a customer account with them
and they never really recognised that you cancelled the contract
within the cooling off period. That's how I understand this.

Why oh why oh why can't businesses just handle stuff above the table and play the good game?
 
iBurst established a long time ago they are not in that game. There is business that can play the game you want.
 
I did IT consulting for a bunch of debt collecting attorneys - and quit after two month because I did not want to be associated with the practices "legalised" by the systems.

Debt collectors are using intimidating blackmail methods to screw money from people fearful of the legal system.

They get away with it because they know the worst that will happen if somebody does complain at the authorities is that they will have to call in a favour to reduce the problem to a minor slap on the wrist.

The only way is the criminal way of extortion (and fraud) charges, and even those are difficult because few people keep proof of anything in an organised way.

In the end this human trait is abused and the victim has to pay, and even worse, he is forced to pay super professional charges to prevent the case from going to court and getting blacklisted. I remember well from my stint at the attorneys the swearing when they had to go to court to get money because the courts usually allowed less than 50% of the professional fees they tried to screw from the debtors.
