However, Icasa’s chairperson Paris Mashile argued that the regulator has not done an about-face and that there is little difference between the draft regulations and those released last week.

Mashile insisted that the regulator had not backpedalled in his response to questions regarding the changes to the regulations governing ADSL pricing.

“There is no material difference between the two provisions but a matter of semantics or choice of words, otherwise the principle is the same. It is, therefore, not correct or accurate to aver that the provisions maintain the status quo,” said Mashile.

However, it is the ambiguous nature of the language used for the new regulations on price that may allow ADSL service providers to continue to maintain their exorbitant rates.

Mashile insisted that the changes to the regulations regarding usage capping were altered after it came to light that the ISPs, and not Telkom, were capping usage.

They really are an incompetent bunch.

This is what I remember

The isp's are capping now, but they were not doing so at the start of this and they were only forced to start capping when Telkom changed the rules 1 Nov 05.

I seem to remember Telkom representatives being caught out telling fibs at the first ADSL hearings about who was capping who. If I remember correctly some prominent ISP's in attendance basically told ICASA , in front of Telkom that the monopoly was talking poofy.

ISP's only cap cause Telkom changed the rules (1Nov05) to suit themselves and nullify their fibs at the hearings.

This is my recollection of events and they might well be wrong, so please correct me if they are.
 
yup they cap, only cause of the structure of ADSL wholesale. There needs to be regulation for network providers too, how the hell is an isp suppose to provide a service when it is a reseller and is not allowed to put in its own infatructure. Regulations of local cap e.g. can't be expected to be fixed by isp when wholesale is as restrictive as it is now, and saix counts local content etc. Typical ICASA + Telkom moves.. :(
 
He knows nothing. Which is a damn shame that councillors will almost always be political rather than technical. Including the chairman.
 
Telkom has the noose tightly around our necks and ICASA pulling the rope, so what's new, we could have a hundred sno's and still be where we are now and forever because the goverment has kicked the chair out from under our feet and that has left us hanging high, the goverment controls ICASA and every one else...

Mashile, usually when it takes 2 1/2 years after the complaint was made to come to some sort of conclusion, things will most likely have changed somewhat. Telkom are a clever bunch of thieves. They have covered their tracks oh so well.

Telkom: "We don't impose a cap, the ISP's do. We are innocent. We are good and clean and fresh, tra la la. You see, that small minority of disgruntled users don't know what they're talking about".

I'm not sure if ICASA are plain stupid or naive or if they are simply as corrupt as "departments" who are supposed to be in place to protect us.

But I must say I find this unbelievably frustrating.

I say we wait until we know for sure exactly what changes (if any) will be made by Telkom. And if we're still not happy, we make another complaint to ICASA and start the whole 2 1/2 year process yet again. Either that or we find a way to do something even more drastic.
 
@ VQuest - the problem is, when is Telkom going to implement any of this. I think if they keep quiet, and pretend like these regulations dont exist, they wont be enforced, and so in reality, they may as well not exist. :(

Based on ICASA's regulations Telkom don't have to do anything that they are not already doing, with the exception of the 30 day installation time and some contention ratio publications, audited by whom is still a mystery, as is the consequences should they fail to comply.
 
I say the time has come to get medieval on their sorry asses.

TIME TO HAUL OUT THE CONSTITUTION!!!

To think we will only be getting back what we had. :p

Before per gig billing was introduced last year, local bandwidth was not an issue according to Telkom.
Telkom can be quoted many times over the past few years where they claimed that Local Bandwidth was not an issue and plentiful. Stephen White comes to mind.

If one remembers back to before November last year that 3Gb Accounts were soft capped to international traffic when a user reached their limit, but local was still available.

100% correct. I feel for ISP's, but they need to also understand that their limitations cannot be held forward as reasons for the consumer not to act or complain. They need to (and I am sure they are) act on behalf of themselves to nail Telkom to free themselves up.

The hiararchy of power currently is (at least in the mind of Telkom and the ISPs) TELKOM, ISP, CONSUMER. It should be the other way around. Consumer drives needs, ISPs find ways to service these needs and Telkom (any new operator like the SNO included) must provide cheap infrastructure for ISPs to do their proper jobs. Obviously the more folks can self provide (this includes everybody from ISP to the man on the street) the better...

The consumer should be king. Government is preventing this for the sake of the backpocket of a few (or some misguided idea that government control of telecoms is somehow good for the South African public)...
