Hi All

I need some advise/reassurance.

A few mins ago I got a very polite email notice from my ISP informing me that I’ve been flagged downloading/violating intellectual property. They directed me to the small print on their website and reading it, I could be in deep doo doo (you agree to the terms when you buy the account).
Attached to the email was a not so polite notice from IS indicating IP, username, “offending” file name etc and a notice from a “agency” in the US claiming to represent the party who’s intellectual property I violated.

I have read a few other threads on the forum about so called “invasion of privacy” but that doesn’t help me now!

What should I do….?

BTW stay the F..K away from “public” torrents…hehehe

Are you download this off something like an uncapped account or is a personal home adsl line or what?

IS don't like people downloading that sort of stuff on uncapped accounts.

Questions, if you don't mind...

NB Questions:
Who is the agency? RIAA?
Do you use a normal ISP account (dynamic IP) or an Uncapped account with one of those special routers that gives you a dedicated IP the whole time?

Optional Questions:
Who is your ISP?

If I were you, I'd stop down-/uploading stuff via torrents.... and ignore the email - unless they require a response from you? If they do, a genetic "The problem has been dealt with and the infringing content has been removed" should suffice. Then install PeerGuardian, and start using torrents again.

Mind PM-ing me the email you got? ;)

Hi Guys

Thanks for replying!

IS Express uncapped, from Openweb (nice guys!)

The "agency" concearned is the "Entertainment Software Association" in Washington?

Anyone know how they log your IP?

:)

Rofl Laughing so this makes it about 4 people now, also(brother) had an nice email luckly my isp sorted it out thanks Leon at Skytec :D

Try peer Guardian 2 it keeps those buggers off your case.
It blocks Ip ranges.

I assumed you used torrents to download nice opensource software and distros... When you download from a torrent, you download data from one/more from the peers and you in turn upload data to the other peers that do not have that piece of data yet. Nice way to distribute load across the internet. What they (eeevil RIAA-like companies) do is they get in line just like a normal user to download the torrent and then proceed to download some data from you to make sure that you are in fact sharing this infringing content - all the while logging IPs and data. Then they just fire off threatening emails to all the owners of the IPs they logged.

What/how does this work?

It is a databse of all the IPs used by those eeevil RIAA-like companies. It then blocks all traffic from&to those IPs. So they cannot connect to you in the first place :D

Next time save your pocket money that mama gives you and buy the original

What jurisdiction does this agency have? I'm sure the worst IS can do is cancel you account :/

Do like Mugabe and tell them to F ... O... they can do **** to you ... Tell them this is Africa, here we do as we please ... (ask telkom):D

Well i have heard that soon isp's in Europe will threaten people if they download illegal items but it's up to the isp as to what they allow no1.

no2 is they don't want high usage on uncapped accounts so they will threaten you to keep the usage down.

Completely ignore it. Move on. I havent even seen a forum post where anything was done about this. The worst thats ever being done was the rather illegal looking attempt by RiSA *spit* on legal South African websites.

IS have to send those official looking abuse emails on. They cant do anything and I dont see them cancelling your account and thereby losing revenue.

Ja... file it in your recycle bin. If they don't like it they can cut off your membership, but that is about all they can do.

... and install peerguardian2

Just ignore them. They can't do anything to you. They have zero jurisdiction here.

This is quite the best advice. Don't make a fuss - just ignore it. ISPs HAVE to appear to do something else they become tacitly complicit. But, believe me, they do NOT want to do anything other than pass the message on. If the email comes out of the USA it has no validity in terms of local copyright law.

There are other threads about this on forum - maybe do a search. Here's one:

But whatever you do, don't fret.

If you like, you could post the guts of the email here ( removing the identifying bits ).

there is no lost revenue on people downloading small amounts on uncapped, there is lost revenue on people downloading torrents all day off uncapped accounts :p, they don't make nearly as much and i would imagine they might cancel the account, so if you work a company ignoring this email just get you into a bit of trouble i would imagine.
