Incorrect Fine issued

So a friend of mine was driving home today from work (In Mpumalanga) and while driving in the fast lane she moved over for a Jeep going a great speed and then as she moved over from the slow lane to the fast lane behind the Jeep the cop pulled her over for speeding. According to them she was going 150 and the Jeep that she moved out of the way for was going 120..lol.

She then protested and they showed her the "footage" from the camera where the traffic Lady has the camera shaking all over the place but mostly on the Jeep and then as the machine "finalize"' the speed she moves the camera onto her car where it registers the speed to each individual car. The fine is R1000. She told the cop it's incorrect but he wrote out the fine in any case and told her she must go to court to contest it if she is unhappy :rolleyes:

So what is the best way for her to sort this mess out...? (minus paying the fine)
 
crumple up the fine, and mindfully dispose of it when you next near a dustbin.
 
ignore all fines until they issue you with a summons. If they do that then go and contest it, or pay the fine. Chances are they won't bother and just crumple it up on their side.

I suppose she can wait and see what happens but knowing her she wouls want it sorted out sooner rather than later.

True, however I've noticed lately from personal experience, if a fine is issued outside the jurisdiction of your residence, the po-po don't bother following it up. They'll send the fine, maybe a warning - but they don't have the financial backing to get an officer of the court to hand deliver a summons (the only legal way of doing it) to you. So they will mostly just scrap them. I've been relieved of 9 fines this way over the last 6 months.

So I'd say ignore until someone comes-a-knockin, then just go "oh, what fine? i thought that was a joke" - then contest your fine in due course. Again, if you show up and make a reasonable argument, 90% of the time the officer that issued the fine won't pitch (case dumped) or the judge will see through the shena****ns (case dumped), or you have your fine reduced. - worst case you pay the fine.

Did she get the camera number, the operators details etc? Especially if the camera was wobbling all over the place means it wasn't setup correctly and therefore all fines from that camera at that time should be dropped due to camera operator negligence.

She went this morning and just paid a reduced fine. Stupid IMHO but each to his own I guess. The hearing would only have been in August and she will have then started a new job quite far away.
 
Yeah it is stupid to pay the fine.
 
Unfair to have been fined, but now she can at least put it behind her and not worry about it anymore.

Yup that was pretty much her reasoning. Still interesting that these machines aren't infallible at all.

If delivered into your hand, it *is* a summons. Next step is court, and contempt of court.
