Information Regulator slaps first spam calling company with enforcement notice

South Africa's Information Regulator has announced that it issued its first enforcement notice resulting from a direct marketing complaint.

The notice was issued to FR Ram Consulting — a training institution — after the Information Regulator found that it contravened various sections of the Protection of Personal Information Act (POPIA).
 
“Our leniency regarding direct marketing through unsolicited electronic communications is going to be a thing of the past because responsible parties (public or private bodies) ignore the provisions of section 69 of POPIA and infringe on the rights of data subjects,” said Pansy Tlakula, chair at the Information Regulator.

The watchdog found that the company hadn’t adhered to sections 69 (1) and (2), and subsequently several other sections of POPIA by:

  • Directly marketing to the data subject without first obtaining their consent;
  • Persistently sending direct marketing communications to the subject via email; and,
  • Giving the subject the option to “Opt Out” but failing to cease communications when they did so.
Section 69 (1) of POPIA sets out that companies are prohibited from directly marketing to customers via any form of electronic communication without first obtaining their consent.

Section 69 (2) states that marketers can only request consent from a data subject once.

Fascinating that they opted to proceed with this route, so one can say that the databasis that are available seems to be Popia compliant, but before you can use that data you need to contact the person to get their consent.
 
they also need to get to those ar5ehole sc#mf#(ks Vodacom - those guys make it a habit to call my MTN number at least twice a month now to try and sell me their fibre solutions - and telling those utter c#nts to stop and to remove my number from their list just makes them give me the middle finger and these f#(ks just keep calling and even though i have blocked over 10 of their numbers - they just call from a different number (obviously since they can create unlimited numbers) ..... they are the worst type of scum there is and they deserve to be hogtied and hung by the balls
 
The only spam filters I trust are the kings of SPAM, GOOGLE AND FACEBOOK.

The sooner we move to GMAIL and WHATSAPP only comms the sooner SPAM will be done away with.
 
How politically connected is this "data subject", or is this just another Pansy spam scheme intended to make it seem like the Information Regulator actually has teeth that aren't in a glass of water every night?

So when are you reporting them?
 
Hopefully vodacom will be dealt with soon, no matter his many times you try and opt out and go into the app to not receive marketing it still happens.
 
They must do something about Vodacom. I've been receiving so many spam sms this last week or so. The more you optout the more messages you get. :mad:
