Insurance Claiming from me

Wondering is someone can advise me.

I was in an accident last month. I ended up writing my bike off.

I was in the wrong, however I made 100% sure my bike did not hit the car. I did however.

All i remember is seeing the number plate off. Outsurance want to claim R7800.00 damages and excess.

Is there any ways I can get myself out of paying this?

You hit the vehicle you are liable for damages. Even if your bike didn't hit.

Sorry, that's how they roll. That's why one needs at least 3rd party insurance.

There is no way of avoiding payment. Even if you die, your estate will have to pay.

You are liable for your delicts.

You can always ask to see 2 or 3 quotes for the repair costs.

The case with bikes is normally. Like this.

R2500 base excess

+R2500 if less than 6 months insured.

+R2500 if learners license.


+R2500 if no third party.

+R2500 if under 25.

Etc etc.


So if you didn't read the policy proper or didn't for the criteria then the excess gets huge very quickly.

You signed a contract for it so that's how it is. So unless you don't claim there is no way out.

You can always ask to see 2 or 3 quotes for the repair costs.

Doesn't always means it's speed related.

Lapse of concentration is enough to have you making an easy mistake in a car but more so on a bike.

Just having the flu and riding can be a disaster.

I got hit in the face by a seagull on Salt River Circle in rush hour... that was fun. I survived, so did the gull, I think.

But riding a bike requires extra vigilance, something that gman123 does not apparently possess.

If yes..
Then refer him/his insurance to your insurance. Do not enter into any further detail or discussion with the other party(ies).

If not..
If you don't try find out from an independent group/person if you may make payment arrangements.

Often you need to learn that to increase said vigilance though.

Sometimes we even need to be reminded and often that reminder hurts.
