Insurance co declined claim

About 3 weeks back, alarm co notified me of activations from a) garden beam, b) living room door, c) detector inside room, so I was quite sure there had been a break in. So told them to send round armed response, who quickly saw the living room outside door wide open and someone inside. Guns blazing (which I doubt, but anyway) they chased the fellow out and he hops over the wall, with the taken items in a plastic bag.

Once in the street he stumbles and falls and abandons the bag and disappears into another property (they find him a few mins later, but that is not the point)

Inside the bag is (my) 2 year old MacBook Pro, a few small silver ornaments and his tools of the trade, a couple of large screwdrivers with which he prises open doors, etc

The MacBook now has a couple of dings on the corner and top cover on account of its journey. I switch it on, it boots to a black screen. No amount of fiddling by myself or a friend who is a computer whiz will fix it. So off to Digicape who tell me logic board is damaged, screen is distorted, and needs replacement, about R20k odd

On submitting claim via broker, ins co take 2 weeks to tell me this is not covered, since the device was not actually stolen. So I am R20k out of pocket. Upon enquiring, I am told to read the T&Cs of the policy, but I cannot find anything that would allow them to decline a claim. I asked them to highlight the actual paragraph relating to the reason for the claim being declined, and all I am told is, your computer was not stolen, so we do not have any liability

Any similar stories? My neighbour's car was stolen from a car park and damaged. His ins paid for the repairs. How is my case any different?
 
I would tell them it was stolen and recovered and get a police number that states this as well. You can also try contacting the insurance ombudsman otherwise the small claims court may be an option(max R15000).
 
The ins ombudsman tell me they have a 9 to 11 month delay in dealing with queries. Have been to SAPS to speak to an amazingly stupid person behind the counter. He could just not understand that I would want to report something that was not stolen
 
Why is your broker not dealing with this? You employed them to handle your short term risks policy.

Your insurer can only repudiate based on policy wording. If they cannot point you to the clause, or refuse to do so, to my mind they are deficient in providing you with valid reason for repudiation and you should report them to the Ombudsman for the industry. (this in actual fact is the reason one employs the services of a broker - if they are not doing this for you, I would suggest terminating their services).

To my mind the claim is valid. There was forced entry to your premises. Items were removed from your premises without your knowledge or permission. Items were recovered by your armed response company, damaged by the perpetrators of the break-in. They were stolen, albeit for a very brief time. There is no reason for repudiation.
 
Do the ombudsman part and let them know you have to buy another as its a work requirement and you would like insurance to pay you cash back

I take it the Macbook is not covered on your All-risks policy? That's probably the issue. Contents insurance only covers items that have been damaged or stolen while inside your property. To cover items outside damaged or stolen outside your property they need to be listed on your All-risks policy.

Laptops should be specified in the all risks section. Then they would cover it with no hassle.

I know this is a little off topic, but what insurance company would you recommend then?
Almost all insurance companies have issues with claims etc.

A good broker will know the insurance companies well and will make sure you are compliant.

I thought all-risks cover was for when you used the item out of the home.

Nope. A laptop is a portable device no matter where it is. Should always be under all risks. It's not about where it goes but rather how easy it is to steal.

Then I definitely need to chat with my broker. And I'm not sure what's the point of adding something like a laptop/PS4 to the household insurance, which increases the premium, if they aren't going to pay out?

Hopefully this is just a Santam thing, because it doesn't make much sense to me.

When I told them that I would not, they said that normal cover would be fine. I also have a Macbook insured for R35000, not All-Risks as I only use it at home.

Both my laptops and cellphones was stolen from home when someone broke in and I definitely did it specify it separately. It was covered under normal household contents.
 
Nothing about All Risks or Household. I use it for a music server, and it does not leave the house. The answer was "It was not stolen, since you have it". A said again, it was ok until this fellow took it out the house, and they repeat the same answer.

The cops wanted to know if I had given him permission to trespass, break open the door, damaging the lock and rummage around inside, and expected an answer. He has 14 counts of burglary on his criminal record, so is well versed in burglary. They had to release him since he could not be arrested, having done no crime
