Charges have been dropped against the three children caught having sex at Jules High School in Johannesburg last year, the National Prosecuting Authority (NPA) said today.
The NPA thought the pupils had been rehabilitated after successfully completing a "diversion" programme, spokesman Mthunzi Mhaga said in a statement.
"We are confident that through the programme, we have managed to address their criminal behaviour... Indications are that they have shown remorse and have taken full responsibility for their actions."
The 15-year-old girl and two boys, aged 14 and 16, were initially charged with "consensual sexual penetration with a child" after a cellphone video surfaced of them having sex on the school grounds on November 4 last year.
The 16-year-old also faced a charge of statutory rape.
They initially appeared in the Johannesburg Magistrate's Court. The charges were provisionally withdrawn on December 2.
The NPA last year said the children would have to undergo a "diversion" programme in accordance with the Child Justice Act.
This meant they avoided standard judicial procedures, like a trial, or criminal records if convicted. Instead they had to attend counselling sessions and "intervention programmes".
"We hope that all learners and children have learnt from this case that law enforcement and the NPA will act decisively against all child offenders with similar conduct," Mhaga said.
