Charges have been dropped against the three children caught having sex at Jules High School in Johannesburg last year, the National Prosecuting Authority (NPA) said today.

The NPA thought the pupils had been rehabilitated after successfully completing a "diversion" programme, spokesman Mthunzi Mhaga said in a statement.

"We are confident that through the programme, we have managed to address their criminal behaviour... Indications are that they have shown remorse and have taken full responsibility for their actions."

The 15-year-old girl and two boys, aged 14 and 16, were initially charged with "consensual sexual penetration with a child" after a cellphone video surfaced of them having sex on the school grounds on November 4 last year.

The 16-year-old also faced a charge of statutory rape.

They initially appeared in the Johannesburg Magistrate's Court. The charges were provisionally withdrawn on December 2.

The NPA last year said the children would have to undergo a "diversion" programme in accordance with the Child Justice Act.

This meant they avoided standard judicial procedures, like a trial, or criminal records if convicted. Instead they had to attend counselling sessions and "intervention programmes".

"We hope that all learners and children have learnt from this case that law enforcement and the NPA will act decisively against all child offenders with similar conduct," Mhaga said.

this is one of those moral dilemma questions that gets people so worked up. if they had been 30, 31 and 32 would this have been an issue? can children at this age be deemed accountable, given the ages maybe it's not a bad outcome, and only the 16 year old would have faced the major criminal charge surely?

Did they actually rape her or just have sex? It is not clear in the article, i read it as a 14 year old boy, 16 year old boy and 16 year old girl had sex and filmed it on their camera's. What criminal charges should there be? these are just kids doing stupid things are you look for a rape charge here?

They are kids, do you want them to go to jail with murderers and rapists as punishment for doing something stupid?

They are kids, do you want them to go to jail with murderers and rapists as punishment for doing something stupid?

my understanding of the story was they were having consensual sex, the law breaking part was because of statutory laws based on their respective ages
 
If it was consensual then I don't class it rape. I do class it 3 sets of useless parents teaching bad ethics though.

My school was loaded with underage girls having sex and none of the guys were charged with rape. It was a standard 6 and 7 popularity contest to nail one of the first team rugby boys.

Teenagers be stupid. That's the problem. I am seriously considering that if I have a daughter I am locking her in the garage till she is 35.

What if the boys were 18, or 20, or 25 ? Why do we have a law for statutory rape ?
 
It's not like the girl was 12 or something. I think the way they have handled this is spot on.

Give them a break, they are kids who did something totally idiotic, i don't see why criminal charges need to be applied here.

the counselling session only apply to kids of a certain age caught in this kind of behaviour (not sure what the age limit is), if the boys were 18, 20, or 25 it would still be statutory rape of the girl because she is under 16, so even though she may have consented, in the eyes of the law she isn't of significant age to make an informed decision, hence any sex with anyone under 16 is classified as statutory rape (in my understanding, any of the more legal eagles on myBB can correct me if I'm wrong).

I'm glad it wasn't my daughter but from all accounts it was consensual sex.

When you consider that a twelve year old child can demand an abortion without the knowledge or consent of her parents can we be surprised at teenagers having sex?
The law actually encourages it.
