Is a refund possible?

Hi guys, my fiance went into zambezi hyundai yesterday to buy a hubcap for her i10. The cost was exorbitant at nearly R600 each. They said they didnt have stock and would have to order in which would only arrive tuesday. she paid by debit card. I was naturally angry at this, i have managed to find one for R100 second hand but almost new. Can she go back to hyundai and ask for a refund? She has not taken possesion of the item. Does the consumer protection act say anything about this?

Any help would be appreciated :)
 
Phone them first thing tomorrow morning - there's usually life at dealerships from 7am onward - and ask that they cancel the order. It's up to their discretion though; I'm not much in the mood to go reading legislation now, but I don't think you'll find assistance in the CPA in this instance. It doesn't protect the buyer against buyer's remorse, which this essentially boils down to. It might change things seeing that you've not taken possession of the item, but I doubt it.
 
Ja, just tell them that the delay was unacceptable and you sourced another one in the mean time. They can't keep your money. You never got anything.
 
If they complain about it, take it, and then take it back the next day. CPA allows returns within 7 days and in this case it wont be opened so should not be a problem to return it..

That said, this really shouldn't be any more complicated than asking for a refund.

After all that drama, me sending the dealer principle a snotty email, she arrived there today to find a brand new notice stuck on the wall next to the spares counter... will attach it... with the salesman condecendingly pointing to the sighn as she approached the counter... karma must be real because they said that there was a problem with the transaction last saturday cause their card machine was sometimes faulty. Even though it showed on the machine that the transaction was succesfull and she even got the usual sms, somehow the money was never transfered to hyundai and they only picked it up while she was waiting at the counter.... they had the nerve to ask her to swipe her card again because it was a special order part! She politely smiled said i dont think so and turned around and walked out! Hahahahaha!! Problem solved... thank you karma

Special order items are exempt from this CPA provision.
