Is the contract data counter fixed?

Mine has been totally incorrect since April. Sometimes giving me 2,7 Terra bytes left of my 350Mega bytes. Then being billed OOB as I could not download the whole internet. I have since fled from MTN and need to know if it safe for people to go back.

I can only speak for myself, accessing the MTN counter via their reseller in my case, MWeb.

It certainly APPEARS to be back up and running again. However my own experience using several data counters on my own machine is that it still has its erratic days, mostly erring by undercounting -- which could come back to bite you when the bill arrives.

To be sure, I take a screenshot of my detailed usage according to their official counter at the end of every billing month, to keep as evidence should I ever (again) be hit by unexpectedly high billing. Three times in one year to date!

They don't reply to queries. I have a ref. no. from ICASA and the email says that they have given MTN 14 days to respond to my query. Today is the 14th day and no response.
They do not even respond to ICASA. They are thumbing their noses at everyone.
I must let ICASA know that they have not responded tonight.

No, they will not. But according to the law, if you purchase a service then it must work without fault. If the service is faulty then you can stop payment without incurring a default on yourself.
Their data counter was not working thereby making you unaware of your balance or giving you a wrong balance and making you going over your cap. This over cap need not be paid.
