Not sure how many of you have been involved with TDNs (take down notices) and ISPA and ECT. I found that in the recent months, this new type of "internet harassment" has exploded and is made a lot easier by ISPA, since there is a convenient form, where everyone can fill out a TDN and then ISPA will forward the request to the ISP who in turn contacts the customer. In self-hosted environments, the ISP will try and force you to sign a waiver (so that they legally are not caught up in anything) should one refuse to do a take down and also threaten to disconnect your network (note: nowhere within ISPA rules or ECT act is there a provision for this)
Neither ISPA nor the ISP will check the validity of the request despite the TDN procedure outlining something like this "Is it technically feasible for the service provider to do what is requested as the remedial action?". So it becomes quite surprising when one receives a takedown notice for a search form such as below:

The above example is probably one of the most ridiculous requests so far (and one very obvious if either ISPA or the ISP had bothered reading the request - the complainant even provided a screen shot of the search form) and my point is that the ISPA TDN process is flawed in the sense as the complainant is (by means of the complainant checking a checkbox) perceived to be the legal owner of content.
Just very frustrating to see how organisations such as ISPA and some of their members stifle internet growth - surely someone should have thought this through properly.
