Issues while using MovingOn

I'm going through a similar thing with a guy I bought stuff from on MovingOn. We opened a case at the police against him yesterday and last night he texted me wanting to have my bank details which I already sent to him weeks ago. I told him I'd already lodged a case against him, so he has until Saturday to get the money to me else I'm not withdrawing and going to small claims court.

Is this a bidorbuy seller? If so, could you email me some details - [email protected] (I just briefly asked people and no-one seems to be aware of this).

If he is a bidorbuy user and has violated our T&Cs/TOS by not honoring agreements conducted on our platform, I would certainly like to know. Just email / PM me your order number and I will take it from there. We can certainly assist you then with the SAPS case and can also freeze his account and perhaps recover funds. The sooner we have this information the sooner we can action.

You're absolutely right. There's no reason for me to protect him, but I'd feel like crap if I outed him and someone knows him personally here. I don't think I'm angry to that point yet.

I don't know if he's a bid or buy user or not as I met him through movingon.co.za

I normally Google number of sellers to see what threads pop up when shopping :whistle:

Ok. So the sale was not done through bidorbuy and the seller did not list the item on our platform? In this case we can't really help you much and the movingon.co.za website (didn't know till now that it existed) would need to help you.

I just looked at their website and I (i am not a lawyer) do not think that their business model is completely above board:
- They say it is not an auction, but yet they run it like an auction. Since they do not claim it is an auction, you can actually invoke CPA on all sales and small-claims court against the selling party (is it movingon.co.za or the owner of the house?)
- The sales are all cash basis (I hope that SARS gets their share of revenue)
- Their website and WHOIS records do not have contact details, T&Cs and do not adhere to the basics of ECTA, PAIA
- It is also unclear who your point of contact for complaints/warranty/cooling off is - is it movingon.co.za or the owner of the house?

Quite surprised that people clear out their household and have a ton of strangers walk through their home buying their house-contents - especially with the crime issues we have.

Lastly: Either movingon.co.za or specifically their agents would need to be complaint with the second-hands goods act (probably an edge case as they do not purchase the goods and resell them, but rather auction the items).

I have seen some sellers list on more than one platform, but I don't know whether Rick listed their items on yours or not.

The MovingOn agent I dealt with is trying to help me and he lodged the police claim with me. But yes, I do think since they connected me with this guy, they should actually be held responsible for getting or giving me back my money. I wan't to see how the police case and my bank action plays out first though before challenging them.

They have two kinds of sales, but none of them actually qualify as auctions.

One is whereby they give numbers to people (doesn't matter whether you arrived there first or not) and as they call out random numbers, you go in and pick the items you want and pay for them. If you're one of the last few to get in the items being sold, chances are you won't find anything decent. I've only ever been to one of those types of sales and we didn't walk through the house. Rather they put everything outside at the back of the house and we walked round the yard.

The second is the one I've had the most experience with as I've transacted three times without any problems and they've all been cash so I'm not sure how the tax part is handled either. In any case you call the agent and he gives you the number of the seller and you get in touch with them directly and arrange everything.
 
I dont think that Moving on is responsible, everything is done by the buyer and seller and no monies are exchanged through Moving On.There is no auction, you rock up at a house and ask the owner the price and everything is voetstoets.
