Outside ESKOM dependency.
WOW. Applied for a RCS card today and being told that I'm listed. Did the Transunion thing and their it was. Rented a shop 2 years ago and I evacuated the premises prior to contractual agreement HOWEVER I got another person to occupy. Phoned the rental agent and they pointed me to the attorneys handling the file. I am at fault, no reason to argue. I don't have the cash to pay the amount in question. What I would like to know is how do I handle this little issue? Would it be advisable to get an attorney myself to handle this? I should obviously get in contact with the attorneys handling this account?

Any advice please. Peace.
 
First things first, for your name to be cleared - you HAVE to pay the full amount. But before then, you need to ensure that proper procedure was followed when the listing was obtained - what type of listing is it? judgement? default? etc... Eight way, they ought to have served you with summons to appear on court or notices or reminders for you to pay. I once was blacklisted by Nedbank when I was young and stupid - it haunted me when I tried to find a job - I needed to pay the amount in full first, then I approached nedbank who send me a settlement letter and a letter recommending that my name be cleared. You need to pay the money owed in full before approaching an attorney for the removal itself. Lawyers can not make the debt disappear - don't believe anyone who tells you this. I paid back the money and only got a lawyer to deal with the courts to get my name cleared. Good luck.

I was in a situation few years back where I got a default judgement against my name cuz the summons was sent to the wrong address, bla bla, long story. In the end I phoned the Lawyers, and negotiated a discounted rate to pay as a lump sum. I didnt make use of a lawyer, because they already had the judgement against me, I did however manage to get a bit of discount once I settled the bill.
 
Judgement by default. I've received absolutely nada. I have not had an opportunity to state my case. I am however fully aware of the fact that I need to repay everything before this little issue in question will be resolved. This is unfamiliar territory, not sure how to handle it though.

You got them a replacement tenant, and they still sued for outstanding rent / breach of contract?
That's a really cr@ppy thing for them to do.
 
Does it not automatically get expunged after a set number of years? I thought this was the case.

The OP made sure there was a continuation of rental.

I would not speak to the lawyers. I would insist on seeing senior management of rental company.
Then discuss the events, and make them note the fact that the OP ensured continuation of rent.

The agency must then clear up their mess, there should be no costs to the OP. If the lawyers want to claim fees, they can lookat the agency.

Ah! That clears that up. Any idea of how many years for the different types?

Judgement prescribes after 10 years IIRC.
Other debt prescribes after 3 years (but you must not have acknowledged the debt or made a single payment in that 3 year period).
TV licenses prescribe after 30 years.
Tax, IIRC, doesn't ever prescribe.

Can't be listed for a TV license. Credit bureaus stopped listing them in '04... Anyone telling you any other story is being disingenuous.

Didn't say you'd be listed. The debt prescribes after 30 years
