ITWorkup: Warning about their legal practices

I'd like to warn people about using ITWorkup.co.za and their new "company"

I bought a motherboard and CPU and received the items although it took around 6 WEEKS.
I barely got ANY communication, unless I chased them and then they barely answered.
So the board and CPU didn't work together, BIOS needed to be flashed, and this was communicated to them. All they did was hardware tests, not even LISTENING or FIXING the problem. And this "testing", took TWO weeks.

They then offered to send the board back.

I refused, and asked for a refund as they were returning an item that does not work for me, and considering this was unseen purchase, I contacted my lawyer. According to the CPA, I am due a refund.

They have blatantly REFUSED to give me money back, only 2K, piss to a big company, and now refuse to respond to makes.

The ITWorkup company may import things straight to you, but when there are problems they are doing suspect illegal activity. How can you by LAW refuse a refund.

Be VERY VERY VERY careful with this company, and it's new "company", as I suspect they just changed names to avoid paying refunds out. But I'm not giving up, will be chasing them. Just pay the money back

Their "email team", because no-one else is every around, ignore all whatsapp attempts at comms and phone calls, so please guys, don't use them, is it worth saving a R100 for when something goes wrong, you WILL lose out.

There was a massive thread that was an absolute mess involving @ITworkup @ITWorkupSupport a week or so ago. It eventually got locked for some reason.
 
They are drop shippers and don't make it clear that they are. That means in many cases no local warranties and of course the longer shipping/return times. Nevermind the public spat the owners had on the forum/internet.

What did I just read?

I always thought I was responsible to do bios upgrades when I buy a motherboard/cpu, unless it was bought as a combo, or even better yet, as a integrated/complete PC.

They can refuse to do anything, by LAW (what even does that mean?)
You, as the aggrieved party, need to compel them to comply, but your lawyer would've told you how to do that...

Pray tell, how would changing a company name even remotely help to avoid paying refunds? Are you talking about your specific demand for a refund? That makes even less sense from a practical perspective.

Also take into account that they did not change their name, instead a new company was created due to a shareholder dispute. If you bought from company 1, any claim you might have, would be against company 1, not company 2.

Is this via the Cssi guys or the original @ITworkup guys that are now Fenway.co.za?

Online stores need to make sure the components WORK together, meaning it boots - How can the purchaser be responsible, when they might not even have a way of upgrading the BIOS?

I don't have to COMPEL them anything, I have an option to return something that wasn't as advertised and doesn't work as advertised, standard CPA, nothing special, nothing complicated. If you buy a flash drive, and it only works on a laptop and not on a PC, is it as advertised? I'm not a lawyer, I'm stating my situation as a warning

I love this one, so think logically, I can go and get 100 orders, CLAIM a shareholder dispute ( where's the proof of this, please I might have missed it ) shut down the company and open another. Without fulfilling the orders, rinse and repeat, and there is NOTHING the clients can do

So confused to the situation I don't know who's where, and who's what, all I can say is the people I have contacted is James, Ulrich and Timoty.
 
I would have thought its your problem to flash the bios unless you are buying one of those packages with CPU, mobo and RAM?

Rather contact the guys at Fenway.co.za, that's the original ITWorkup team who were running the business before they were forced out and have undertaken to support the old orders, the new Cssi guys don't seem to care much about their customers.

Is this really worth going the legal route?
The board isn't broken and it only cost a few thousand, just ask an IT shop to flash it or sell it on and take a small loss.
You may be able to win the legal way but it’s going to cost you a lot more than it’s worth.

What motherboard and CPU did you buy?

The board isn't broken and it only cost a few thousand, just ask an IT shop to flash it or sell it on and take a small loss.
You may be able to win the legal way but it’s going to cost you a lot more than it’s worth.

No one even answer attempts to contact them, so whoever thinks that this is the team that "cares", they obviously don't, and this is NOT an accusation or anything along those lines - i'm simply stating what's happening

And how many other people say the same thing, o, well, let me sell it, or do this or do that, and the people selling items without actually knowing what they selling ( is this because that drop-ship? ) should be held accountable.

Example: Is it ok to sell T-Shirts and deliver Shirts, but it's ok because the seller can just re-sell them.

If you think the legal way is the easier cheaper route then all the best and keep the thread updated.

I'm confused. You bought a motherboard and CPU from them which didn't work so you sent it back to them? At which point/who told you a BIOS upgrade would fix the issue? Did you do the BIOS upgrade or send it back and ask them to do it?

I remember there was quite a widespread issue with that gen cpu and mbb, the board won't post without the bios update with that CPU installed so the op can't update the bios because it won't post.

I would say it’s fair to say it’s a returnable item in that condition unless the issue was communicated before purchase because as is the op can't use the board for the intended purpose, he really shouldn't be needing to pay someone to flash a brand new mbb. But that being said it’s probably going to be easier to just make a plan than fight with the retailer.
