In terms of a ministerial determination as permitted by section 6(3) of this Act: employees earning in excess of R 149 763-00 per annum are excluded from section 6 to 17 and 18(3).
They're excluded from the automatic limits. I've seen previous decisions which indicated that the intent was that those earning more than the threshold would be in a position to negotiate suitable limits rather than meaning an employer can simply require someone to work whatever hours the employer dictates for no additional compensation.
 
One last thing. Any idea on how the dispute will work? Would she need to get a lawyer? What would the fees be (ballpark figure). I'm just picturing her and her lawyer against a major organisation and all of their lawyers...

One tiny little word of caution ... once you go the legal route your girlfriend's working environment will never be the same.

Rather speak to management and if they can't make a plan then she should look for another job. But a bad reference can really damage your career - rather leave on a good footing than get lawyers involved.

And the chances are high that if she is unhappy with the situation they'll find a way to work her out of the job.

I really do understand your approach here, but i totally disagree with you.

I honestly believe in standing your ground (within reason).

By simply walking away for a sake of a good reference, hasn't solved a thing.

Only thing accomplished here is passing the buck on to the next poor sod.

Fact is, generally speaking (i know this horrible to do) in South Africa, large corporate's really take advantage of lower income earners, simply because they know if they threaten their source of income GENERALLY they will comply. Hence they get to save a buck or two with this methodology. Hell if they come short on a few people and actually end up paying them, the bastards are still smiling from all the revenue saved from their scrupulous methods.

Sad fact is, we as society would rather protect our own well being than rectify problems at hand.

@private ryan, i wish your gf the bets of luck and honestly hope that she has some sort of recourse other than just walking away.

The woman told her straight, you don't get paid overtime in retail, I was like what? :confused:

The place she is currently working at business day ends at 17:00 (stated in the contract I think) however she works a minimum half hour overtime every day. They fill her time card out for her, ended 16:30.

These companies rely on intimidation and employees' lack of knowledge of their rights. And they do this when they could potentially get into a lot of trouble. The abuse was even worse in the past.
