Landmark judgment on garnishee orders

Just an opinion based on my observations at my workplace and through acquaintances....every single person I know that has garnishee orders, also smokes or drinks, or has DSTV premium.
 
NOBODY is FORCED to take on debt. EVERYBODY has a CHOICE. If you CHOOSE to get a contract for a cellphone that's worth more than your annual earnings, then you don't get to complain when the provider demands their legally mandated monthly payment.

And the argument about "unscrupulous lenders" is ridiculous. What lender would offer a loan to somebody they KNOW isn't going to be able to pay it back?

The fact that a court is enforcing a judgement that makes people LESS responsible for their choices is just idiotic. Why don't we just mandate that everything must be free and see how that works out?

Like others have said, this root of the problem is people being duped into debt they cannot possibly repay - I recall the case of the washing machine that Lewis sold to a man.

Here's to hoping this is the beginning of curbing the problem that causes people to end up with unpayable debt in the 1st place.
 
Get fired from your job, can't get work. Only one salary left. Take on debt or let your children starve?

If you can't afford to service basic day-to-day needs like food, taking on new debt is absolutely the worst thing you can do. This is why you should have savings, or be willing to sell your assets to cover rough patches. I appreciate that many of the country's poorest do not have this luxury, but again, they should not be indebting themselves.

BTW, my parents were in exactly this situation when I was growing up. It didn't end well.

Exactly as I noted above with the cellphone example. If you don't live beyond your means, your chances of getting into financial difficulty are significantly lower. Yes, being financially prudent is difficult, and yes it's desperately unfair - but that is unfortunately the system we live in.

1. But they take the loan of R1000 but are financially illiterate so don't understand the R1140 initiation fee and the R200pm loan insurance and the lender salesperson tries to minimise highlighting those costs as much as possible because they just want their commission on the sale...

2. Manmade systems, so we can change it as we want.

Not really, the poor will just pay less on debt to cover these costs as well, which has become a necessity due to corporate greed. Sorry for lenders, but no more days of getting money back at high interest rates in a short period of time. Now, get only back what you are owed, with capped interest over many, many years.
