Wizix, i agree with you and it will be costly and it will most probably be an affair that drags out, <i>but</i> that should not stop us from doing it.
Remember: Justice exists (amongst other things) to ensure that no party takes an unfair advantage over another.
Its important to remember here that if it can be proven in court that they are in the wrong then it doesn't matter how much money Sentech have.
What i do think we should discuss at length is the following:
<u><b>a. Who is going to be our representative?</b></u>
One of us is going to have head up the group that leads the class action, this person is going to have to have a lot of time on his hands because he will be our representative with Sentech, and as such it will be his job to liaise with both us and the lawyers, as well as being present when ever action is taken on behalf of us, or action is taken by sentech. This is a big job.
<u><b>b. How do we decide the costs for this? </b></u>
I could very easily sit here and watch as someone else does all the work and runs around. I dont have to lift a finger, and hey presto, i get a court ruling that hopefully is in my favour, without putting my balls on the line (as such). Of course this is not fair for those ppl that make the mission to go to court, find lawyers, discuss our position etc...
I also wouldn't put it past Sentech to use dirty tactics against us as a group and against the person whom we choose as out representative: By this i mean intimidation and threats, possibly digging the dirt on whoever the leader is. Think media exposure. I think if we started to put the squeeze on Sentech they would grab at whatever they could get, and try use this to their advantage
Assuming this was to happen, if we could prove it in court we of course would have a stronger case.
I do think its certainly worth examining our options here and possibly electing a 'temporary' representative who can go and seek legal council, just to decide whether or not we have a case here.
My recommendation here is to use the legal action as a last resort. In the mean time we still have these strategies that we have not used:
- Picketing with a mass group outside Sentech offices (of course with TV crews, photographers, journalists etc...)
- Getting nationwide FREE media exposure (think TV interviews, articles in the sunday times, live radio interviews etc.)
- PAYING for nationwide media exposure (Full page news paper adverts etc)
- Guerrila tactics: Graffiti campaign on main roads and big intersections (www.sentechsucks.co.za)
I was also thinking we could get a bunch of cheap stickers made and we could all go around and stick them *everywhere* (like go to Sentech HQ and stick them all over the parking lot and all over the toilets, go to big shopping centers and put them in lifts, on those damn parking lot booms, payment machines)
- Of course there are some net related things we can do, most of which have been discussed at length (google bombing etc)
- deliver a petition that we have all signed demanding an official response, apology, possibly a rebate, and that they put up a comprehensive website detailing the status of the network
- Discuss our options with icasa, although this will take a long time, they exist (beleive it or not [xx(]) to enusre that no-one takes us for a ride

* lets assemble a task group to co-ordinate and organise the above mentioned tactics (we need a jhb/pta group, a dbn one and a ct one)
* lets try all the other options we have at our disposal, we dont know if they will work or not, and if they do then we have no need for a class action</b>
