Hi
What's the current wisdom around dealing with a man refusing to pay maintenance in terms of his divorce agreement?

Can you just go to a police station and lay a charge?

Thanks

Yes, maintenance court, I was dragged there once for a child which proved not to be mine. So I'll start there.

Go to any court, there's a maintenance court section.

There is a court order in place. It just needs enforcing. Still court or can we just lay a charge at the police station?

Well the warrant of arrest (or whatever needs to be done) will issued by the court.

edit:I was never arrested, so I wouldn't know :)

A friend of mine was an Advocate in the maintenance court until he started at the public protector. He said they will pursue a garnishee order.

Ok but what is the process for kicking this off?

You need to approach the prosecutor and they will take matters from there.

Is it maintenance for the ex-spouse or kids? Just curious.

Thanks. Assume I'm a complete Noob, how do I approach the prosecuter?

With your feet, aim your chest towards him and start walking. This should ensure a successful approach.

Just go to the court and ask if you can meet the prosecutor/have his number/email.
