Makro

Bust on my end. Spoke to head office rep. Apparently we will be consulted and offered a voucher for our inconvenience....

Personally I don't expect a voucher for any inconvenience (since there hasn't been any)... just a refund really if they aren't going to honour the original items description, quantity and price.

Got a call from the branch where I was going to collect the beer telling me that there was an issue with the order and I should expect a call from head office to tell me what the problem is.

Uh oh you in trouble now!

I drove to the branch after they said i could collect. Thats an inconvenience.

I usually wouldnt mind but im pissed they changed my order description online without letting me know.

Seems they have themselves covered:

Obvious errors
We regret that no order will be accepted if we identify an inadvertent and obvious error in the prices of products or services or the description of any of our products or services or the on the Website.

I wonder if they can refund my eBucks account?

I just got back from the store, to a nice box of three waiting for me, informed them to check the order confirmation which clearly states 12 x 330ml x 3, then I somehow ended up on one of their in store phones having a "nice" talk with the store owner, then with the store manager in person who apologised and told me it will be delivered to me for free.

Which either means I won or they are going to call/email me and tell me they will refund the money.

People moaning about schit  Getting all huffed up when their attempt to exploit an OBVIOUS mistake backfires :erm:

I don't see anyone moaning - just relaying their experiences.

I haven't heard back from Makro yet - but I'm really not concerned - R30 worth of eBucks isn't the end of the world.

Ok then, lets paint this in a different light...

Ignore the fact that the product was incorrectly described/priced (we all knew it was, and took a chance)...

Lets sayyou order 200 of X item from Makro.... and without telling you at all, they just changed it to 20 because well they felt like it. How would you react to that?

The fact that it was OBVIOUSLY incorrectly priced cannot be ignored. If you do that, it's not even the same scenario. For someone to clain that they honestly thought they could het 12 beers for R30, and didn't know or assume it was a mistake, is laughable.

Ok, if you can't see the issue that I am complaining about, then there is no helping you really.

I reckon there's a better than good chance the OP would have got his ordered filled despite the mistake if he'd just kept it to himself until afterwards.

I agree actually...

If it had just been him, and he'd order 3 or 4 .... they may have fulfilled it.

Head office called.

Order is being cancelled and my eBucks are being refunded.

Oddly enough, I got an email stating that my order will be fulfilled when they got stock again.... I will leave this for a day or two and see if HO phone me though...

That's just BS. What exactly would an obvious error be? It's not always clear when its an obvious error. This disclaimer just give them unfair protection to willy nilly retract any of their advertised deals. Obvious Schnobvious...
There should be some protection for the customer in the CPA against BS disclaimers like this.

The onus should not be on the customer to always be a specialist and clued up in the area of product prices... to know what is a reasonable price and what is considered an "obvious error". I'm sorry, but I don't agree with this.

12 craft beers for R30 is an obvious error.

Seems the CPA doesn't really cover online orders in the way you think it does:

What happens when a retailer displays the wrong price? Let’s say, for example, the price displayed for a cell phone is R120 when it should be R1,200. The consumer sees R120 and thinks “Great, that is a good deal!” and decides to buy it for R120. The consumer gets to the till and is told “Sorry it is actually R1,200”. Is the retailer or supplier obliged to sell it for the price advertised? Can the consumer insist that they can buy it for R120 and get a deal of a lifetime?

In today’s retail sector a situation like this could occur in either:

a shop in which case the Consumer Protection Act (CPA) applies, or
online in which case the Electronic Communications and Transactions Act (ECT Act) applies.

And then...

In terms of the ECT Act, online retailers are required to provide the consumer with a sufficient description of the goods which will enable the consumer to make an informed decision. What constitutes an informed decision is not clear from the Act. The online retailer must display the full price of the goods including any additional extras such as transport of the goods and taxes (Section 43).

The ECT Act gives no direct guidance for a situation where an online retailer displays the incorrect price for goods or services. However, the ECT Act does require that any Terms and Conditions applicable to the transaction are available to the consumer through the website on which the goods or services are being sold. It must also be clear to the consumer how to access those terms and conditions (see Website Footers).

Online retailers must have clear terms and conditions.
Most online retailers regulate, in their terms and conditions, the situation where the price of goods or services are incorrectly advertised on the website. The scope of the rights of the consumer and the liabilities of the supplier for such a situation is found in those terms and conditions.

Online consumers must be provided with an opportunity to:

review the transactions;
correct any mistakes that they identify with the transaction and
the opportunity to cancel the transaction before placing their final order.

Edit:

And Makro have clearly defined Ts & Cs that cover this situation - so they are completely in the right to not honour the orders that a lot of us made.

Should they have modified our order history without notifying us? Probably not. But that's a different issue altogether.
