Johannesburg - The ANC plans on laying criminal charges against Economic Freedom Fighters leader Julius Malema.

This was after Malema told Al Jazeera that his party would "remove this government through the barrel of a gun".

"His utterances are treasonable and constitutes a violation of the IEC charter which was signed by all political parties... committing them to a free and fair election," ANC national spokesperson Zizi Kodwa told News24.

"We would expect the state to act against this conduct. The state must investigate treason charges against him [Malema]."

and what if he is found guilty? he will apologise and the ANC will be forced to accept, unless of course if his apology does not carry the same clout as that of No 1

Of course they are

as are Zuma's actions in firing Nene and his actions with Nkandla, etc., etc., etc., and, etc.

The ANC needs to catch a big wake-up!

And yet "We will kill for Zuma" was all good and fair...?

Malema was asked what this meant and if he was "literally" saying people should take up arms against the government.

Malema responded: "Yeah, literally. I mean it literally. We are not scared. We are not going to have a government that disrespects us

As much as I disagree with the ANC on most things, this kind of rhetoric isn't good...

I think he's going to come back with the defence of their violent retaliation being conditional of election rigging.
The interviewer did ask whether Julius meant taking up arms, and he confirmed that he meant it in a literal way, so there's no hiding behind misinterpretation.
Will be interesting to see what happens.

Malema was careful to make his statement conditional.
There is actually no imminent threat here unless the ANC themselves break the law.
That will be his defence in court.
I don't like it any more than anybody else, but no actual crime has been committed here yet.

It's like me saying, "if somebody tries to rob me I will shoot the guy."
If somebody commits a crime against my person I will defend myself with force.
The ANC is jumping the gun here, exactly what Malema wants.

Exactly what he wants, he missed 'the struggle'... so now making his own. General Malema - Struggle hero sentenced to life in prison, out in 25 years to become president after civil war

Treason? You mean that thing your president did when he sold out to the Guptas?

Criminals protecting criminals while calling each other names, yawn.

Although they could probably argue that if the condition is a foregone conclusion or a matter of pure opinion by the threatener then the conditionality is irrelevant (e.g. "If the sun rises tomorrow, I will kill you" or "If I don't like what you do, I will kill you").

Of course, but in this case it is not.
