Just wanted to share my story with Mango Airlines and want to find out if what they are doing right now is even legal.
So I recently had a flight to JHB from CPT booked for 07/08/2020 and return back to CPT on 10/08/2020. Mango advised for whatever reason that both the flights, original and return, have both been cancelled and offered me alternate flights on each respective day, which I was unable to take due to work constraints.
As a result of their cancelation of the flights, I am requesting for a refund and have been advised by their refund officer that I will not be able to get a refund and I will instead receive a voucher instead to compensate.
This is something I do not want because I have no other plans to travel in the near future and I would prefer a refund which the refund officer says is not possible.
According to point 3 specified below from the CPA Section 46 of ECT:
"(3) If a supplier is unable to perform in terms of the agreement on the grounds that the goods or services ordered are unavailable, the supplier must immediately notify the consumer of this fact and refund any payments within 30 days after the date of such notification"
Legally speaking and according to the CPA, aren't they obligated to issue me a refund?
Or am I being a fool here and missing something
