Hi all,
If you are married out of community of property with the accrual, and one spouse is unemployed? Does the property get registered in both names or the working spouse?
 
The accrual means anything acquired after marriage is shared unless specifically contracted through a official and recognised party.
 
Thanks for the reply. My question is my spouse and I applied for a joint loan but was declined on affordability on my side recently being retrenched. I still carry most of the bills and paid the deposit for the house using my severance pay. Therefore she could apply for the bond on her own and was approved. Can the bond be registered in my partners name and the property in both our names?

you can use 1 set of financials to apply for the bond but put it in both your names.
I did this, although it was before i was married, i dont think it would change though after marriage

Accrual.
 
I'm not sure that there is any practical benefit in putting it in both of your names. The value of the property would still get split in a divorce regardless and in the case of a death it could actually cause bigger issues.

It's actually quite common for the house to be put in the name of the spouse least likely to be involved in a private business. The thinking is that it can provide a level of protection against debtors should the spouse's business fail.

Does not matter.
After marrige starts everything is acrude
meaning your bright red sports car, the home bought after wedding day, the jewelry invested in.
That multi million Rand business you started while married.

It all gets shared on divorce. Unless there was a contract with the accrual ANC....

Only stuff each keeps is whatever they had before entering into said contract, rest gets shared.
