Hi guys, Yip i'm taking the plunge soon :D Does anybody know where to get a marriage contract in Jozi area?

You're nearest lawyer. It needs to be registered with the bond registrations office also.

That is a very stupid approach, no offence.

You never know what is going to happen, so plan for every possible eventuality. Not to mention that an antenuptial contract protects your spouse's assets if you start a business and go bust - under COP they'll go after her stuff too.

This is always the reason given by people who do not want to be married in COP, and frankly, it is getting a tad stale. The majority of people are salaried employees and will never start a business.

As you say "if you start a business", so why would you call his approach stupid if he has no intention of starting a business. Why enforce your opinion?

What if your wife turns out to be a raving lunatic who sleeps with your father? Will you stay married in that case?

Blu - same story holds. What if one of the partners is retrenched and can't find work, and creditors start sniffing around? Under COP they can go for the other partner's assets...

Sure, no-one wants to go into marriage thinking about what could go wrong... but with something like 50% of marriages ending in divorce nowadays, can you afford to take the risk? Even if you believe marriage is forever, you can't force your spouse to believe it too if they decide THEY want out...

Legal requirements and its not just about what happens if the marriage ends.

My wife has her own business and it was just practical to do an ANC with accrual and nothing to do with what happens if we separate.
 
This whole argument against anti nup contracts is senseless. People claiming old school or you must be in it for the long haul. Don't actually understand the point of anti nup.
You can sign an anti nup that for all intents and purposes makes your marriage COP. Except when the law or tax man comes knocking. It is purely to protect your family from the government and other financial powers, as much as possible.

Only difference between being married CoP and ANC with a "50/50 in case of devorce" contract signed: is that in CoP the law forces you to consult with your partner on financial matters. ANC, it is purely your own relationship that encourages this communication.
I prefer my marriage to be held together by our connection and not forced together by law thanks.

The ANC will absolutely dictate what happens if you ever seperate.

People forget that marriage per se is a contract. It just happens to have (in some cases) an emotional/sexual/whatever other aspect to it.

Yes it is, and so that "hidden contract" is valid regardless of which legal route you take to get married. Whether ANC or CoP, it should not change your relationship or marriage in the slightest. And so, getting married ANC with Acr is merely the best way to protect your family from outside powers. CoP carries all of the risk with no more reward than ANC does. As we can agree that the "hidden contract" of marriage is actually the one that your relationship cares about. That one is not altered by your legal choice at all.

How about protecting assets when spouse is sued about something.
