Microsoft faces $5m Xbox suit

Seattle - A man who claims Microsoft's Xbox 360 scratches game discs has sued the company, saying the consoles are "negligently designed and manufactured".

Brouwer said his Xbox 360 scratched two games, Gears of War and Madden NFL 07, and that Microsoft offered to replace them for a $20 fee. He is seeking more than $5m in damages, according to the court filing.

Can somebody explain to me how you can sue somebody for $5m in damages if your actual loss is not even $100? :confused:

Now, if he had bought a PS3 and some games, it may have cost him that, but an XBOX?
 
Apparently XBOX returns due to malfunctions are as high as 33%

Back on topic. Sounds to me like this guy has been doing lines on his discs and now needs cash to pay his dealer so he has gone and hired his dealer to be his lawyer. You know, in the US he may just be able to pull it off.
 
I have heard about these disk scratching problems... anyone experienced it this side?
 
Let MS give him the X360 Halo 3 special, a couple of game vouchers and off he goes like a happy pig! Hooorah for bribery & corruption! :p
 
Have my X360 for over a year now ( 2nd unit though ) and no issues with scratching with no discs whatsoever. RTFM seems to be a severe issue with PEBCAK users. ;)
 
I scratched a disc, when tilting the console while it was on. My fault. Certainly am not going to sue for it.
 
Have scratched Gears and Oblivion on my console. no tilting... never moved the thing..

MS replaced it...
