Mistake in advertising Keyboard wrong price (Logitech)

Hi Guys,

Just wanted to find out some info on rights regarding mistakes in advertising.

Over the weekend I was looking over purchases at bid or buy and saw a really cheap Bluetooth Keyboard that I thought could come in handy when I hook my mac to my projector.

So I hit the link and I'm really impressed by the info. I Google Logitech Bluetooth Keyboard and takealot and kalahari both have the same keyboard for around 1500 rand. Same product code and everything!
Checked the website directly (the name was on bid or buy) and it had the same low price as advertised on bid or buy.

So I figured it's either a mistake or a scam/fake. Despite this, I went ahead with purchase and paid for the keyboard and delivery.

Didn't hear from them so I called in today and gave them my order number. Went something like this :


Sir I'm not picking up that order number. Oh bid or buy sorry let me put it that in again. Oh yes am I speaking to Jeffrey?

Yes. Just want to....

Did you receive the email?

What email?

Okay sir I'll jus forward it to you again.

Uhm okay. Just wanted to find out when I can expect delivery.

Sir the price for that keyboard is over a thousand rand on the website. I don't understand but there must be a duplicate page or something.

Oh okay so let me check the email and get back to you.

Now I've got the order number and product info and payment info saved. Should I force them to give me the product they advertised or should I have a heart and let it go. The guy sounded quite nervous on the call.
 
It's from an online retailer called First Shop.
 
How much was it advertised for? They had an issue last year where a ton of products were priced wrongly. They didn't honour the prices. Seems they still didn't learn their lesson. I'd ask then to honour their pricing, if not I'd let as much people know about the incident as possible.
 
To answer your question: Errors in advertising due to mistakes are not legally binding. Advertising is just an invitation to do business, rather than an offer as per contract law.

Specific to your case: Your order and their acceptance thereof (if I'm understanding your post correctly), may well constitute an agreement of sale, and thus be legally binding.

Disclaimer: This legal advice is worth exactly how much you paid for it. Also, the moral fall-out is only yours to deal with, so you'll have to decide how you'll feel each time you look at the keyboard and remember the loss they made :)
 
Lol, thanks for the advice Dean. Yeah, I've got mixed feelings about it though. Everyone makes mistakes.
To the guys asking, it was advertised at 10% of the price.
