Motorcycle accident advice needed

Hi guys

So i had an accident on Monday. I was going along and a drunk driver veered into my lane and impacted me from the front. I went flyind and he went running. Luckily some witnesses ran and caught him.

I was placed in a neck brace and rushed to hospital. Luckily i wasnt severly injured. I went to the police station yesterday to get the case nr and all that for insurance, apparently the prick spent the night in jail.

So I tried getting the driver's information and was told I cant get it until an investigating officer was appointed. I cannot start the 3rd party insurance claim without his information.

I sustained damage to my bike clothing, notebook etc which was in my back pack at the time.

So apart from getting insurance claimed against him, what would i need to do to claim damages from him personally? I have never been in an accident so not sure what to do, hopefully you guys have some advice...

I had an accident with my car a couple of months ago, some guy rammed me from behind.
I submitted my claim to my insurance and gave them the other guy's details. They then claimed everything from his insurance and also paid me back my excess that I had to pay.

I'd say give your insurance a call and check with them.
 
I have been in contact with them and they need his info which im trying to get from the cops. Im sure it will be paid out either via 3rd party or if he didnt have insurance i will have to take the excess myself etc. My concern is the R10000+ damages i wont be able to claim from insurance. Must one press charges or sue ?
 
Are you insured or are you not insured? I see a uphill battle coming your way. If the insurance does not pay for the damages, get yourself a good layer. If he is found guilty in the criminal case, use that in your civil case. Your layer will inform you. Years ago I had a similar incident and never got paid the amount I should have :-(
 
I am fully insured, im not sure about the guy who hit me...

If you have the police case number - and have given them the details of what happened, they can't refuse to do the claim... they can find out the details of the other driver themselves. (e.g. what happens if he wasn't caught, they won't pay?)
 
Guys i am 100% sure my insurance company will sort the claim part out. My concern is with the stuff that they wont pay as it wasnt part of the bike as such

You can look at claiming from the road accident fund for all your inconveniance & injury. Note it will take you a very long time to get anything & the lawyer dealing with this will probably take a commission...
 
Never even thought of that, as i understand you can claim if you suffered personal injure?

You should have some sort of cover for the stuff you had on you....
