MTN and e-mail spamming.

One of the users on my domain's e-mail adress was handed out in a spam mail from a mtn loaded customer and sent all over the show. I am trying to get the info of that specific user to a. Report and have them shut down. b. Institute legal proceeding against the spammer and the company who they are spamming this crap for.

I spoke to person a, who referred me to person b, who referred me back to person a, who then referred me to person c who then..u guessed it, referred me to person a again.

This leads me to believe, MTN doesnt know their *********s from their elbows and they have no idea whjats going on in their own organisation. Any ideas as to who to contact..as 083 1 808, 083 1555 or the fraudline (?! ) 083 123 7867 cant help me.
 
Wow. Since i firmly believe people from MTN read these forums, i can now with all honesty say, MTN is a haven for spammers and their customer service sucks as bad as their product. After trying my best to get the morons at their customer service department to get a supervisor or someone with more than 2 braincells on the line, u guessed it....still no feedback. Oh joy, this morning we recieved another mail, citing a valid adress in my domain as a contact for some free giveaway...and yes...MTN loaded once again. Wake up ya yeller bastards....

I have instructed our laywers to fire off a letter to the company in question. As for details. what do you need?

I spoke with our laywer and he said the following. The people on the MTN side of things are just the "Go between" or " Passers on " of the message and cannot be held laible under the Electronic Communications and Transactions Act of 2002 or as per section 45(1) of same act. It would be costly and almost a certian no win situation to try and persecute the people who responded to the mail. They will pleade stupidity and i will agree on that. So in essence, MTN cannot be held liable, or their users cannot be blamed for forwarding a mail to 20 people containing false\incorrect\fraudulent information. The spammers in this case, are normal users, who, are inadvertantly spamming. They should be keelhauled for being stupid in my opinion, but , then again, thats just me.

On the other hand, the company responsible for sending the mail , will be receiving a letter demanding an immediate retraction during the course of the day. This, of course is a moot point, as the damage is already done. So much for that one. NONE of this information was obtained by talking to MTN or getting any help from Aubrey ( 083 1555 ), Linda ( 083 1 808 ) Thabang ( 083 1 808 ) or the person who answered the phone on 083 123 7867.
