MTN throttleing BIS downloads?

I have a bb9700 and since last week my downloads have been throttled to an average of 30KB/s which is dreadful compared to the 160KB/s average I used to download at.
At first I thought it was a network problem until I tried downloading a file using a different phone. That lead me to think that the problem was wit my phone so I swapped sims with another blackberry, only to find that my phone was downloading at normal speeds with a different SIM inserted, and the other bb was only downloading at 30KB/s with my SIM in it.
So I called MTN today and explained the story, they refreshed my BIS but the problem was not solved. When I tried calling them again a consultant told me that excessive downloading (which I have been doing :-D) will result in speeds being throttled.
So basically I just want to verify the legitimacy of "the throttleing" by identifying other users who have experienced this and how long it takes to be refreshed...

(My "excessive" usage was nowhere near 8.1GB a day so I'm feeling really hard done by this)

It's called throttleing, not capping, and it's the first I've heard of a mobile network doing it on BIS. Anybody else have this?

You're not crazy - I've also seen incredibly slow speeds from 3G the past week. It was on my BlackBerry which uses Vodacom as well as my home internet which uses Cell C. I was beginning to suspect there was something amiss with 3G in general.

I am getting the same problem, on mtn and 9700-
i initialy thought it was my OS( 9700/6.0.0.600 ) and its not (I updated 2ce in the last week!
Its not the towers either.
I get 30kb/s in bellville,goodwood and cape town CBD and at all times of day and night

On this call with mtn did they say when it will be reviewed?
Ps, in your contract does it say anything about them screwing around with our service that we pay for?

I wanna read mine (when I find it) cuz its bs
Wonder if consumer protection act has our back?
 
I think the best thing to do is check your speed at about 2am in the morning.
 
The bis conditions are quite clear, it's only for browsing and mail not for downloading, it was only a matter of time before they limited os6 devices in the some way.
 
So I called MTN once more yesterday nd had a really long chat with one of their consultants(fresh from BB training). Long story short, he had no idea MTN was doing this so he took a few details(2 different numbers that had different speeds etc.), he told me he would forward the issue to MTN technicians and they'd get back to me within 48 hours... I'm still waiting.
I think however, that MTN has a "fair usage policy"(I think that's what its called) on a monthly basis to BIS, I'm not exactly sure on the numbers but it should be quite high as I was able to download 2.5GB yesterday on a different SIM at normal 160KB/s speeds with no hickups, or, I could be totally wrong...

I am having my speed throttled as well. Thought it was me alone but I guess MTN has decided to crack the whip. I think best thing to do is find a BB that's used lightly then see if it still maintains average speeds. Also I wonder if the refreshes are done monthly or when they feel you have repented :) in my case my spped was first cut to around 50kbps then 30kbps and now I hardly go above 20kbps
