After always having cellphone reception in my house, suddenly having no cellphone reception in my house. Cannot make calls, cannnot receive calls, cannot sms, cannot receive sms’s, cannot do Internet Banking because I cannot receive sms with OTP no. Cannot do business. Paying for a contract that I cannot use.

Told Lina, MTN call center, to pass message to Xolani, her boss, that I am going to ICASA, newspapers with complaint and to attorney to sue MTN for fraud. MTN is selling thousands of contracts and pre-paid daily, knowing that their networks cannot supply the demand. This is FRAUD! Because of MTN overload, I, a MTN client for years, have no cell phone reception!

This saga has been going on since Tuesday, 9 June 2009. Today is Monday, 10 August 2009, and I have received no reply from either Xolani or MTN. Does anyone else out there have similar problems with MTN reception?!

Now what will happen when you don't pay MTN for two months ... they'll be onto you in a flash with legal and financial ruin threats that they have the power to execute. This is what is so very wrong in our country. Can/Will the Consumer Protection Act change this one sided relationship into a more balanced one?

If there are legal guys on this forum, please advise what customers can do to get fair treatment when it comes to these big bullies.

The lawyer is just after your money. You see there is something called terms and conditions when signing a cell contract. And I am just as guilty as the next person for just signing away and running off with a new phone and number. In these T&C you will see that the cell operator offers NO guarantee of it's service and you are still liable for all costs even if there is no service. If you singed the T&C pages when you first got your cell well there is nothing that can be done.

If you want a real horror story try and get your hands on the T&C pages and have a good read. You will find that even if you die you will still be liable for the remainder of the contract costs. Doesn't make it right, but we sign anyway!

Omigosh this is horrific! No I never read the terms and conditions. Perhaps we could get them to change their terms and conditions. Not impossible, I reckon

Just come back from seeing my lawyer. He reckons the only probable way would be to boycott MTM, hitting them in the pocket where it hurts. I suppose that could work, but sadly, would not be as dramatic as suing them

MTN Overload-Fraud

You can always make a complaint with Icasa.

I thought of that on the way back from the lawyer. I have read in the past that Icasa is already onto MTN, so perhaps when the public start contacting Icasa as well they may be more foreceful. Perhaps we all, who are aggrieved, complain to Icasa! Let me know what you think

Just thought of something. Anyone willing to sign a legal petition to Icasa if I set it up on the petition site http://www.thepetitionsite.com ?

just threathen to go to consumerwatch on ur local radio station ... in Durban, theres East Coast Radio and it really stirs the pot ... so first email MTN and cc the radio station correspondent and see what comes of it ... letters to editors of your local newspapers, etc might to do some good ... best ask your lawyer on the legality of what I mentioned and go ahead if he approves ... btw, we get ripped off in one way or the other, cos we are charged the highest bank charges on earth, get the worst cellphone deals on earth, and of course we live in the most dangerous place on eart .... so go figure ...
