My GF just bought a nokia 'phone from Woolworths.

She is Scottish and retruns to Scotland once or twice a year, so she was looking for a 'phone she could put an overseas SIM card in and use it over there, but in the small print it says that she can only use the MTN SIM card that came with the phone, she cannot use the phone outside of South Africa and she cannot use her existing Vodacom SIM card.

That's BS, surely they can't prevent you from using an item that YOU bought for anything you want to use that Item for?

Its law they can't lock to a network

Put a Vodacom sim in and see if it works. They may be referring to the warranty that will be void if you use a different sim.

As I understand it, under the ICASA rules 'locked' phones can no longer be sold in South Africa. But in practice my local dealer says that several of the lower-priced (i.e. subsidised) handsets are still locked. If that is so, then once again our laws are toothless.

Bought a low-priced Nokia 1200 handset (was bundled with an MTN sim). I simply inserted my CellC sim, and it worked straightaway.

I haven't signed any T & C's, just paid for the phone and buggered out of the shop

MTN Practices

With my experience of the terms of the mtn pre-paid bundled phone purchases the fine print referred to is the extended 12months mtn provides over and above the 12months warranty that the manufacturers provide.

mtn has yet to retail sell a network locked phone since the laws ending such practices came into affect.

I have bought phones from Cell C and Vodacom recently and they work fine on all networks. I have heard that MTN still network locks their phones because they are a crappy operator.

You heard wrong, maybe update yourself with the ruling about locking of handsets
