MWeb getting in on MyADSL

I've noticed on the MWEB site they have a link named "My ADSL" which points to myadsl.mweb.co.za.

It has worked nicely for them, they are listed fourth for a google search on myadsl.

Are they allowed to benefit from this?

EDIT: My point being, if MyADSL used the word MWEB to describe a service would MWEB allow it?

Is MyADSL a registered trademark or copyright or whatever? Coz im guessing MWEB is. So no-body can use the MWEB name without permission. But could use the Term MyAdsl freely (as long as it isnt copyrighted)
 
Its kinda like Myadsl using mweb, or google, or telkom in any of its web addresses.

Trademarks are extremely important to businesses, but most dont realize this.

according to the MyADSL Terms & Conditions:
3. INTELLECTUAL PROPERTY RIGHTS
3.1 All intellectual property on the Website, including but not limited to content, trademarks (or any confusingly similar trademarks), logos, pictures, video, downloads, domain names, patents, design elements, software, source code, meta tags, databases, text, graphics, icons and hyperlinks are the property of or licensed to MyADSL and/or MyBroadband and as such, are protected from infringement by domestic and international legislation and treaties. Subject to the rights licensed to the User in clause 2, all other rights to intellectual property on the Website are expressly reserved.
3.2 No person may use logos, icons, or trade marks from the Website as hyperlinks or other purposes without MyADSL and/or MyBroadband's prior written consent.

Since when has hyperlinking become so damn precious? I seriously doubt a link constitutes trademark infringement. This is just silly.

Clearly they have used (abused) 'myadsl' to gain some brownie points on the google page rankings.

They could of easily used - youradsl, suckersadsl, theiradsl or whatever else.

myadsl aint registered as a TM.....?

Its not about the link, its about using someone else's brand that they not entitled to.
