My consumer rights?

Hey guys, my girlfriend got a 2010 hyundai getz from the hyundai dealership. 34000km
The thing is she signed the papers this morning. So the car is now hers.
As she was driving on the highway she noticed that the car was pulling to the left.
She phoned the hyundai salesman and he said it is strange bec the car must go through a 125 check (including wheel alignment) before it is sold.
It has gone Through the 125 check and it passed.
He said she must take it in monday and they will reallign the wheels.
Upon closer inspection, the bonnet gaps on the right and left are not even, the one left gap is wider then the right side.
The right side of the bonnet where the gap is narrow is a bit lifted, it is not flush with the light (it is flush on the side where the gap is wider)
The concern is that the car is pulling to the right side where it is thinner.
So there could have been damage to the front right side.
I cant see any paint differences.

My question is do cars come with manufacture errors like the bonnet gap differences and the one bonnet gap a little lifted?

if we do find that it had been in an accident, what are our rights ad consumers?
We did not ask if the car has been in an accident but i did say over the phone that i will take it if it hasnt been in an accident. He didnt not say no it hasnt or it has.
This is actually our first car we have purchased and we dont want it to turn into a nightmare.

We actually went through a proper dealership like hyundai to try avoid problems.

She has signed the papers, if we are not happy what can we do?

From what you describe; definitely looks like an accident smash, panelbeaters never ever manage to line up the panels 100% ever.
You can check for yourself, jack front up (becareful), or go to a tire shop & put on lift ramp. While they will spray what visible - tell tale signs can always be found on the chassis! Look for paint splashes/splotches or variantions around the chassis - remove wheel (on side, pulling), inspect axle carefully! If beyond you, you can for a small sum get a very detailed report from the AA (cheaper if you/family connection is member). With that report you can confront the dealer!
I'm not sure about CPA issues, legally - but I think dealer should give you in writing any know faults, accident damage, service history, etc - but as I said am not 100% sure.
 
The dealer is compelled by law (CPA) to show you any patent or latent defects on the car.

Panel fit is not necessarily a sign of accident damage, and is more often than not shoddy factory workmanship. Alignment should have been checked already, and is, in fact something that can fail a car for a Roadworthy test. Don't try and take comfort in the 125 point check garbage, as it's not worth the paper it's written on.

If the car is not sorted out to your satisfaction, you are within your rights under the CPA, to return it and receive a full refund, so don't worry about the fact that your GF has signed anything.

You are lucky that you went to a proper dealership like Hyundai, as they have a name to uphold, and are also very rigidly bound by the CPA.

If they cannot sort the car out to your satisfaction, see if they have another similar car that you do like and ask them to take yours back. I returned a Polo that I wasn't happy with, after 10 days (WAY before the CPA) and received a full refund and was allowed to choose a new one that I did like. It happens quite often so don't fret.

We took the car through finance?

I think i will take the car to AA tom and have it checked...
Im gonna be sandton side tom, any AA branch that side?

Ouch! Definitely sounds like accident damage to me. The easiest way to see if a car has been in a smash is misaligned panels which is what you are describing.

Only AA I know of in the north is in Strydom Park, just off Malibongwe. There are probably more, just not sure where they are.

There is no difference between cash and finance. You are covered by the CPA either way.
 
What Fazda said is true, new cars may have misaligned panels, but I've recently gone and purchased a i20 and had a careful look before buying.

Each one of them had very tight tolerances and were perfectly symmetrical (went to about 3 dealerships and inspected a few of them). Unfortunately I didn't look at the i10 and because it is so much cheaper it might be less well constructed but my guess would be that the car was indeed in a crash.

Return ASAP!

They will work very hard to stop you or dissuade you from returning the vehicle. Simply say no, and get the money back.

Those cars sell extremely well and I've had a look for 2nd hand models, not many around. Of those around a significant amount have probably been in accidents.
