This morning on my way to work, my car was rear-ended by a VW Caddy. I was not a fault (I kid you not). Looks like my back bump needs to be replace and a dent on my boot.

The guy doesn’t have insurance and I don’t want to go through my insurance because their legal department sometimes can’t claim from the 2nd party (because people dodge payments) and the around turnover time from claiming back is between 3months to 3years.
Now I’m being a nice guy by going the cheaper option and not getting the insurance involved. The guy said he will pay cash.

This is where I need help; I’m looking for a Panel Beater (reliable) to repair the damages. There might be damages to the exhaust but that will need to be checked. I live in the Sandton area and don’t mind traveling to Midrand / Sandton / Wynberg for a shop.

I drive a 1997 White Honda Civic.

PS. I already have a Case No. from Sandton Police. I have the guys contact details, ID NO. and work line. There’s no running from me, I will ruin him. (I actually told him that in a friendly way)

I would use my insurance to have it repaired, even if they cannot reclaim the money from the other party that is not your problem.

If your insurance does not want to pay change your provider. What happens if the damage was R100k worth, would you still cover it out of your own pocket even though you have insurance?

If you dont mind going to Albertsville (JHB, near Northcliff), there is a Panelbeater who does a good job. Turn-around time is about 3 days.. PM me for details

I called my insurance (Not your way, hint hint). They will try to reclaim but when you are re-rated, your premium will be increased. WHY???

I didn't do anything wrong. Is it my fault he doesn't have insurance? Or rear-ended me?

I told them to escalate it and I want a call before the end of today or they gonna lose a client, a client since 2008.

As far as I know, in a "rear-end accident" (not an ass joke please...) the car in front (again...) is not at fault in 99% of all cases (this ofcourse excludes pulling the handbrake etc.).
Rules of the road - only proceed when it's safe to do so, so if the driver behind bumps into you they're in trouble. [Had a bumper bash a while back - a lady in a Lexus bumped into me after I had to brake & swirve to avoid hitting someone that suddenly stopped to turn right. Luckily the damage took 2 minutes of polish to fix and she claimed full responsibility]

As for your insurance company... Santam perhaps?

No, seriously, you have to consider a better insurance company. It's their job to fix your car and pay for it - they have funds for exactly this type of situation (something like a liability fund or something fancy).
There are many drivers out there taht do not have insurance. You pay a premium each month to avoid exactly the situation you find yourself in. Why pay them if you have to pay it yourself anyway?
Threaten them with the ombudsman.
As the saying goes in Afrikaans "Jammer om van jou kak te hoor".

This is not a lecture, your insurance company is taking you for a ride and doing so using some of the lamest excuses in the business. Stand fast and demand payment.

--- I bought a brand new Hyundai Accent last week. Full comprehensive insurance = R682p/m.
My old car (Kia Rio 2007) through Unity = R940p/m switched to iWyze = R438p/m

For that alone you should leave them. They threaten to increase your premiums if you actually make use of the service they owe you? @#$% that, get your car fixed and once everything is sorted change to another provider.

I logged a complaint on Hellopeter and I got a call within 30 minutes from a Service Consultant, saying my query went up to the head of Risk. She explained what claiming would mean... but at the end of the day she explained the same thing. That this would affect of rate?!?!

She said lets log a claim and assess the damages and take it from there. Honestly if this counts against me, I'm going to throw a fit and make Miway understand. I've been a client since 2008 with no claims.

Why should honest people be penalized for using something they pay for.
