Noisy neighbour

We have a sociopathic neighbour who amuses himself by using power tools pretty much all day long. He lost his job some time back, or was fired, or resigned, and will regale you with racist rants about why he's unemployed. When he's not cutting, planing, grinding and so on, he is ranting at his gardener or dog or setting the dog on the gardener. To make matters worse, he's deaf, and has the ability to not hear when you try and reason with him.

We have no evidence that the noise is part of an illegal business, which is against municipal by-laws. The City of Tshwane needs multiple complaints before they'll take a noise complaint seriously. Our problem is that the noise is during the day and most of our neighbours are out at work, so this would be difficult to get.

What can we try.
 
Is your neighbour an owner or renter? Is this a flat?
 
He's owns the place. Both properties are houses.
 
You could record him setting his dog on the gardener and have him arrested. Or just post the video on social media if you love watching the world burn.

You may not be able to nail him on noise pollution as its during the day which is pretty legal. However find out if he does work for others and complains that he is running a business illegally from home. Businesses that disturbs neighbours dont go down well.

Noise Nuisance, on the other hand, is more subjective and usually happens over a longer period. It’s defined as noise that “disturbs or impairs or may disturb or impair the convenience or peace of any person,” and could include dogs that bark incessantly, the roar from machinery, or any, similar, pervasive sound that makes your life a living hell.

Michali and Chantelle warned, though, that, “In order to show that a Noise Nuisance exists, a reasonable person must find a certain noise intolerable or seriously effecting his enjoyment of his property."

If its constant noise. And if they are running an illegal business.

Have a look at the Home Occupation rules for your suburb. Nuisance to neighbours as a business is a no go. You are generally allowed to run a business from home in most suburbs, but there are some rules. No signage, parking to be provided, 60% must be for residential purposes, can only be during specific hours.
