Nokia N97 endless problems

I just want to find out something my Nokia N97 has given me problems about 2 weeks after I got it on contract from MTN,the charging port is faulty,the first time i sent it in they replaced all the internals so the IMEI number changed still didnt fix the problem sent it in for the second and third time problem its still not fixed my phone just wont charge(its not the charger).

So what I want to know is,is it possible for me to get a new phone from MTN because ive sent in 3 times and its for the same problem?

Does it charge over USB cable to the PC? Sounds like a charger issue tbh but if you say its not I would imagine Nokia Care would be able to sort it out. I doubt MTN would change the phone.
