A power struggle is brewing between new Police Minister Fikile Mbalula and former Hawks boss Mthandazo Ntlemeza over the latter’s ejection from office.

Ntlemeza insists that he is still in charge of the Hawks and will turn up for work on Tuesday, in defiance of Mbalula’s letter instructing him to “hand in the tools of the trade” and “vacate the office” of the Directorate for Priority Crime Investigation.

Mbalula gave the instruction following a second High Court order this week, enforcing the

implementation of an earlier ruling that Ntlemeza’s appointment was unlawful and should be set aside.

Mbalula also reversed his predecessor Nathi Nhleko’s decision to challenge the order in the Supreme Court of Appeal (SCA).

He immediately appointed Yolisa Matakata, one of Ntlemeza’s deputies, as the acting head.

However, Ntlemeza was adamant that he would go ahead and lodge his own appeal, and should therefore be allowed to continue in his position pending this process – a stance that has led to a high-stakes standoff between the two powerful men.

The 61-year-old Ntlemeza said he intended to remain in office until 2022, when his contract expired.

In his letter to Ntlemeza this week, Mbalula thanked him for his service and ordered him to leave immediately. The court also ruled that Ntlemeza should leave the premises even if the appeal was pending.

“You are hereby informed to hand in all the assets of the employer, including tools of trade, within 24 hours from receipt of this letter and vacate the office,” Mbabula said, carrying out his first major decision since taking office after the Cabinet reshuffle, announced on March 31.

However, Ntlemeza, who is holidaying with his family in the Eastern Cape, told City Press in a telephonic interview that “he remains in charge” of the Hawks and that “only Parliament can remove” him.

Personally I am not buying this "standoff". Sounds a bit too scripted. Or maybe I am just untrusting of Mbalula and his boss.
 
He obviously only takes orders from his boss, and that isn't the Minister of Police. Or the courts.

Johannesburg - Minister of Police Fikile Mbalula has sent a stern warning to former Hawks boss Berning Ntlemeza to toe the line.

Speaking to journalists on Sunday, Mbalula said Ntlemeza and his lawyers should stop writing him letters and rather write to the courts.

This follows a City Press report that a power struggle was brewing between Mbalula and Ntlemeza over the latter’s ejection from office.

"We are not in the Bold and the Beautiful. If he understands the law properly, he will understand his place. I'm not the court. He doesn't have to write to me, they must write to the court. If they well educated and not illiterate in terms of the law, they will understand they do not have to write to me," he said to journalists on Sunday.

City Press reported that Ntlemeza insisted that he is still in charge of the Hawks and will turn up for work on Tuesday, in defiance of Mbalula’s letter instructing him to “vacate the office”.

On Wednesday, the High Court in Pretoria dismissed Ntlemeza’s application for leave to appeal its March judgment, with costs. It ordered him to vacate his office immediately. Former police minister Nathi Nhleko had also brought an appeal, which Mbalula has since withdrawn.

Mbalula swiftly announced that Lieutenant General Yolisa Matakata would be taking over from Ntlemeza.

Mbalula warned that he would ensure that he would execute the law should Ntlemeza report for duty.

"I'm implementing the court decision. He [Ntlemeza] says he is coming by force. It's fine, we will see him there and the law will be executed."

He told journalists that he does not need the drama adding that he had work to do.

"I'm not going to be entertaining what General Ntlemeza is saying to the press. There is no standoff. I'm the minister of police not Ntlemeza."

Why not fire his ass and be done. He can already be fired on the evidence used to remove him at the head of the hawks

Durban – Police Minister Fikile Mbalula has made it clear that former Hawks boss Major-General Berning Ntlemeza will not be allowed back on Tuesday to lead the elite unit.

Mbalula was speaking to the media on Sunday during a visit to Soshanguve police station, where he expressed condolences to colleagues of slain Sergeant Philemon Sibiya.

He was reacting to a media statement by Ntlemeza that he would report for duty on Tuesday, despite the recent high court judgment preventing him from doing so.

Mbalula said: “He must just vacate in peace. He doesn’t need the drama. He is an old man. He must go home and relax and look after his children. We are not in the Bold and the Beautiful here.”

Ntlemeza didn’t have to write to him if he had problems with the court judgment, the minister said.

“I am not the court. He doesn’t have to write to me his lawyers must write to the courts. If they are well educated and not illiterate in terms of the law, they will understand that they don’t have to write to me.

“I am implementing the court decision,” Mbalula said.

Commenting on Ntlemeza’s statement that he would be coming to the office, he said: “It is fine. We will see him there, but the law will be executed. We don’t need drama.

“We have work to do. I am not going to be entertaining what General Ntlemeza says in the media.”

Seems everyone is missing the point in this façade. Why was he appointed to start with. Now its this soap opera.

Cant really be a demotion since his appointment was scrapped thus he wasn't in the higher position to start with. More of a go back to where you were.

How can someone not be suitable for a position as a head of a law enforcement institution, yet hold a senior position in law enforcement institution??
