Seller shouldn’t be paying anything.

Transfer fees and bond fees, but the latter only applicable if actually getting a home loan.

Why is your wife even going to sign anything? The buyer is the one who goes to sign things.

My employer is the seller and I keep getting things mixed up as I'm also the head of finance for my employer so dealing with it as the company representative.

It’s a little concerning that the head of finance of a company wouldn’t know these things though…

Sounds like a conflict of interest situation...

But anyway... As the buyer, you pay the transfer attorneys and the bond attorney and if the house is priced over r1m... You pay SARS also (via transfer attorneys)...

Flat was professionally valued and I'm getting a 10% discount off the list price as an employee.

Everything is above board with the directors signing off on the sale. I'm just the finance manager so responsible for the paperwork on behalf of the company.
 
**** me I'm dealing with a **** agent and situation.

Offer was put in on a house before I saw the ad, but the buyer is currently in breach as he has failed to come up with his deposit in terms of his OTP (something to do with transferring funds from China.)

So I saw the place, and like it, but this agent is really getting on my tits. Extolling all the pros, revealing no cons even though I'm 90% she knew about them (including damp in some of the kitchen cupboards). Says there's been no crime in the area but the immediate neighbour pointed me to 2 or 3 units which have been hit over the years.

Also pushed back on me wanting to choose attorneys, and immediately gave me the name of the (supposed) seller's attorneys, which I took to mean that's it's actually her mates and she's getting a kickback.

Now won't address the issue of the damp and says she'll discuss it after I get pre-approval before I put in an offer, and pre-approval will be done with a BO she works with, even though I don't necessarily even want to go with a BO.

Skip, or put all the issues in your otp and either lower your price or make the fixing of it part of your otp. Id go with the first option.

You can add a favorable home inspection clause in your otp then get a company to do an inspection, adjust your price based on the home inspection.

The bo is bs, and you can get pre approval from any bank. Good idea for piece of mind.

Legally she must present your otp to the seller, so just hammer her and submit an otp. If she keeps on ask her to confirm the steps in email and then nail her with their governing board.

She's irritating me so much. She's obviously angling for the 1st offer to go through as her work is then done, but jesus what a shitty regard for ethics.

Does she have exclusivity on the property?

Breach is breach, has the seller informed the original purchaser of the breach yet, and has he given a reasonable amount of time (if any) for it to be remedied? You can ask for this in black and white, no sense in pursuing it if the original offer is still in the running.

I'm assuming the seller knows about the breach as the sale hasn't continued, prospective buyer was supposed to deposit an amount by last Thursday. The buyer definitely knows as he's the one with the OTP and he hasn't made payment.

There is no amount of time per se, because there were no other offers on the house they're willing to entertain the buyer's stories/delays as they would rather do that than have the sale fall through completely, unless other offers come in.

She clearly only wants your offer to light a fire under the original purchaser. No sense in pursuing something like this unless you are assured that the agent has sufficient motivation to present it.
Look for something else, and stop taking her calls, it's a waste of your time.

It sucks, because this place ticks all the boxes.

Buyers with an excellent credit record are always good to have on their books, and in this current economic climate, can be quite rare. She can always sell you something else, or even upsell you.
Whatever her reason, no-one likes to play reserve, and there is nothing worse than arriving on match day to be told that you are playing reserve. At least she could be upfront about it.
