Question regarding levies, PQ and renovations in a sectional title.
In my complex a few units have an open small air courtyard in the middle of the double story unit. Its roughly 12sqm. (estimating 4m x 3m, might be a bit bigger). The owners can opt to cover this area and can get 2 extra rooms of 12sqm, one upstairs and one downstairs. In a unit size of 154sqm, an addition of 24sqm would be huge. They could extend their lounge downstairs and make an office upstairs and still have full use of all the bedrooms.
There are a few units in my complex that have done more than 2 years ago, and I just saw our levy schedule and those units have not been adjusted to account for the renovations. On the schedule their unit shows 154sqm. I raised it with the managing agents, they said when the units are legalized then the PQ and thus levies will be updated etc.
But here's my question, shouldn't approved plans be required to build such a structure? Would a certificate of occupancy need to be issued by a municipal inspector? If there is no certificate of occupancy, can that unit be occupied legally?
