I just heard on the radio that the RTIA (the guys who administer traffic fines) have outsourced their collection process to 3 companies. One is MBD, the lawyers for the sabc who blackmail and threaten you. Another involves Rael Levitt and Barry Tannenbaum...

Expect to have your family harassed all night if you have an unpaid fine.

Yep have already had sms's from the MBD group, ironically for fines that I have already paid so I am not sure why?

I did not answer their sms's and have not heard from them again (but it could be the calm before the storm).

Personally I cannot see how RTIA can outsource the funds collection because fines are an "admission of guilt" to breaking the law. If you do not pay it means you claim you are not guilty and therefore should be going to court for the trial. If you do not pitch up at court for the trial then you are contravening a law and therefore it requires law interaction such as a summons or warrant for arrest, not a bloody collection firm to collect the outstanding funds.

Besides it would be interesting to see how they get away with the fact that RTIA are issuing illegal fines in the first place by not sedning them via register mail.

Fcking idiots.
 
They're now outsourcing the collection of "admission of guilt"???

I see this holding up in a court of law, I promise.

No it will not...

A fine has a legal value, they may not double it, or add charges or anything of the sort.
 
Pfft, got another SMS yesterday re: an unpaid fine/warrant, etc. Never received anything in the mail, and there's nothing in viewfine, either. Think people are going to start taking chances with this.

Hehe thats what you think , I recieved a fine for R 1000 for not having my drivers licence on me, i forgot the fine and about 8 weeks later started getting calls from the collection company stating i owe them R 2500.00 , I quickly went to the department and paid R 250 by producing my licence + an additional R 250 late payment penalty, when the collection company called again i sent them proof the fine has already been paid.

They will add additional costs to the fine and say its collection costs.

And that will make the fine (admission of guilt) illegal...
 
Does MBD ever take anyone to court? I thought their whole business revolved around intimidation. Would they even know what to do if someone insisted on going to court?

The likes of MBD basically just make up the amounts they claim are owed. Typically they cannot even provide any documentation showing how they reached their figures.
 
The pilot project started in November last year and it "ended" end of March. So the SMSes that you receive now should matter because the contract has expired. I got one beginning of this year.
 
I wish they would outsource Horror Affairs and the licensing department. We might actually get timely service.
